be a conditional use or variance in Master Program, the City shall submit <br /> said permit to the Department of Ecology for final action. <br /> B. The Department of Ecology shall render and so notify the City and the <br /> permittee of its final decision approving or disapproving a permit for <br /> a conditional use or variance within thirty (30) days of the filing by the <br /> City, pursuant to WAC 173-14-090. The City shall notify those interested <br /> persons having contacted local government pursuant to said final decision. <br /> Section 19: APPEALS FROM CITY GRANTING, DENYING, OR RESCINDING <br /> OF SUBSTANTIAL DEVELOPMENT PERMITS: <br /> A. Appeal procedures are described by RCW 90.58.180 and WAC 173-14-170. <br /> B. Appeals must be filed with Department of Ecology within thirty days <br /> of the final permit decision by the City. <br /> Section 20: ENFORCEMENT: <br /> A. The City shall have the authority to serve upon a person undertaking or <br /> about to undertake development a regulatory order if: <br /> 1. The development constitutes an integral part of substantial develop- <br /> ment being undertaken on the shorelines of Everett in the absence <br /> of a substantial development permit, or <br /> 2. The development being undertaken, although an integral part of <br /> a project approved by an existing, valid substantial development <br /> permit is outside the scope and intent of said permit, or <br /> 3. The development being undertaken on the shorelines of Everett <br /> is not consistent with the Shoreline Plan. <br /> B. The regulatory order shall set forth or contain: <br /> 1. The specific nature, extent and time of violation, and the damaage <br /> or potential damage; <br /> 2. An order that the violation or potential violation cease and desist <br /> or in appropriate cases, the specific corrective action to be taken <br /> within a specific and reasonable time; and <br /> 3. The right of the person to whom the order is directed to a hearing <br /> before the Shoreline Hearings Board. <br /> C. A regulatory order issued per this section shall become effective immediate- <br /> ly upon receipt by the person to whom the order is directed and shall become <br /> final unless review is requested pursuant to Section 21. <br /> -11- <br />
