The structure currently <br /> used as a dwelling located at 2617 Colby was changed from a dwelling into a business use by <br /> Permit B9105-040 in 1991. A certificate of occupancy was issued at that time for the change of <br /> use of that structure from a dwelling to business use. It is therefore a violation of the code for <br /> the building to be used as a dwelling. To convert the building back to a dwelling a new permit <br /> would need to be issued and a new residential certificate of occupancy secured. <br /> A deck permit was applied for in June of 2010 (Permit B1006-035). The deck as submitted <br /> represents construction in accordance with the International Residential Code with no further <br /> comments or review required. This permit is otherwise ready to be issued, however cannot be <br /> issued because it does not comply with the International Building Code which is the governing <br /> code for commercial structures. Please find the plan review letter dated July 7, 2010 that <br /> describes the deficiencies in greater detail. The City could issue a permit for a deck at this <br /> address that is shown to comply with the International Building Code. <br /> I hope that I have answered your questions completely.
