I IIIIIIII
12. Please list all factors you corred in determining whether to issue thUtblation Citation"to the property
owner as opposed to the tenant occupants. Pursuant to EMC 1.20.010 and City practice to issue violation
citations for work without permits/unlawful structures to the owner of the property who is responsible for
the structure on the property.
13. Please provide the date that the City of Everett adopted the code sections cited in your"Violation Citation." The
International Property Maintenance Code was originally adopted in 2010 and is applicable to existing
structures. The IRC was originally adopted in 2004 and was preceded by the Uniform Building Code. Both
codes are automatically updated every three years after the International Code Council issues latest edition of
the IPMC and the State Building Code is updated. The most recent iteration of chapter 8.20 EMC was adopted
in 2014.
14. Please provide the date that the City began requiring permits. This question is too vague to answer, but
generally building permits have been required since 1908.
15. Please provide the name, address and phone number of the Assistant City Attorney who will be handling this
matter for the City of Everett so that I may send them a copy of this discovery request. I will be assisting code
enforcement on this matter as needed.
Sincerely,
Katie Rathbun
Assistant City Attorney
City of Everett
2930 Wetmore Avenue, Suite 10-C
Everett, WA 98201
T: 425.257.7007
F: 425.257.8693
From: Jerry Froland [mailto:jeromefroland@gmail.com]
Sent: Monday, May 23, 2016 11:35 AM
To: Katie Rathbun
Subject: Re: CE16-0313 - 1211 Everett Ave.
Thanks Katie. I'm leaving town for two weeks starting this afternoon. I will not be back until June
3, 2016. I know we have a hearing date of June 9, 2016. Is there any chance that can be
continued?
If not, I do not want to blindside you and I have not had time to prepare a proper response so I want
to get some information to you before I leave.
Regarding violation#1, alterations to create four additional sleeping rooms, both my client and the
tenant will testify that (i) They have not altered the residence; (ii) the house was built in 1930 (per
Snoho records) as a three bedroom house and no additional rooms have been added; (iii) The
property was rented to John Lucas as the sole tenant in a single family residence; (iv) When the
Landlord learned John Lucas was subleasing the property, the Landlord required John Lucas to
evict the sub-tenants at his own expense; (v) John Lucas told the tenants to leave; (vi) The tenants
refused to leave; (vii) John Lucas hired Rob Trickier to evict the tenants and the eviction began
with service of a Notice to Terminate on 2-9-2016 (vii) The eviction process is still ongoing as to
one of the tenants.
_/ 2 ,/
