Officer Wathen observed and <br /> photographed that the single family residential structure had been altered to <br /> accommodate a rooming house by constructing additional interior walls and <br /> enclosing a back porch to create another room. The alterations to the structure <br /> were conducted by a previous owner and completed without required City permits <br /> rendering the structure as unlawful. <br /> 11. On July 29, 2016, Mrs. Froland contacted Officer Wathen and informed her that an <br /> architect had been contacted to produce drawings for a permitapplication. Mrs. <br /> Froland requested additional time to comply with permit requirements. A third <br /> Notice of Rescheduled Hearing was sent via first class mail and certified to the <br /> Respondent scheduling this matter before the Hearings Examiner on September 29, <br /> 2016. <br /> 12. On September 26, 2016, Officer Wathen contacted Jerry Froland and he requested <br /> additional time to complete the permit process and obtain all required permits. A <br /> fourth Notice of Rescheduled Hearing was sent via first class mail and certified to <br /> the Respondent scheduling this matter before the Hearings Examiner on December <br /> 8, 2016. <br /> 13. On October 12, 2016,Kelsey Heyd, City of Everett Planning Department, notified <br /> Officer Wathen that a non-conforming certification (NCB) was required in addition to <br /> a building permit for the residential structure on site. The NCB was being <br /> processed and the applicants had been notified of additional plan corrections <br /> needed before a permit could be issued. <br /> 14. On October 27, 2016, a fifth Notice of Rescheduled Hearing was sent via first class <br /> mail and certified to the Respondent scheduling this matter before the Hearings <br /> Examiner on December 15, 2016. <br /> 15. On November 9, 2016, upon review of City records Officer Wathen determined that <br /> permit (BW1.609-00.3) had been issued to the Respondent and NCB 16-037 had <br /> been approved. . <br /> 16. The Respondent was informed by the City official that they have the right to contest <br /> the violation citation at a hearing in which the City bears the burden of proving by <br /> clear and convincing evidence that the violations stated in the citation did occur. <br /> The Respondent elects to forego a hearing and instead enter into this Stipulation. <br /> By entering this stipulation, the Respondent and the City agree that the facts set <br /> forth in the violation citation and in this stipulation are true and accurate and cannot <br /> be contested at a later date in this or any other proceeding. <br /> 17.
