2 <br /> kitchen and bathroom. John Lucas,a tenant, occupied one of the four rooms. John <br /> Lucas was subleasing the rooms without the Respondent's permission or <br /> knowledge. Prior to any action by the City, the Respondent observed that John <br /> Lucas had permitted other people to reside on the property. John Lucas was <br /> provided with a notice requiring him to either evict all the other persons from the • <br /> property or to vacate the property. John Lucas hired an attorney to begin eviction <br /> proceedings. The complaint to Code Enforcement by Robert Beazin was in <br /> response to the eviction proceedings. Following the inspection, upon research of <br /> City records, Officer Wathen determined that no permits had been obtained for the <br /> alterations conducted on the single family residential structure on site. These <br /> conditions were in violation of International Property Maintenance Code (IPMC) <br /> 106.1 Unlawful Acts as adopted by EMC 16.005.010; IPMC 108.1.4 Unlawful <br /> Structure as adopted by EMC 16.005.010 and International Residential Code (IRC) <br /> R105.1, Permits Required as adopted by EMC 16.005.010. <br /> 5, On April 15, 2016, the City issued the Respondent a violation citation for violations <br /> of IPMC 106.1 Unlawful Acts as defined by IPMC 108.1.4, IRC R105.1 and EMC <br /> 8.20.020 (A)(D)(E)(G). Copies were mailed to the Respondent via first class and <br /> certified mail to the Respondents last known address which Officer Wathen <br /> obtained from,Snohomish County Assessors Record. A copy of the citation was <br /> posted at the property. (Pursuant to EMC 1.20.010.C.1) Before initiating a violation <br /> citation, the City did not contact the Respondent to request compliance. • <br /> 6, On April 20, 2016, Jerome Froland, registered agent for the Respondent, contacted <br /> Officer Wathen to request disclosure documents pertaining to this matter be <br /> provided to him. Officer Wathen was responsive to the request. <br /> 7. Mr. Froland requested a continuance of the hearing because of travel conflicts on <br /> May 24, 2016, a Notice of Rescheduled Hearing was sent via first class and <br /> certified mail to the Respondent scheduling this matter before the Hearings <br /> Examiner on June 23, 2016. <br /> 8, On June 13, 2016, Officer Wathen reinspected the property and observed and <br /> photographed that all discarded items and overgrown vegetation•had been removed <br /> from the property. However, Officer Wathen was unable to determine if the <br /> residential structure on site was occupied. She observed two windows of the <br /> structure had been boarded.. Upon search of City records Officer Wathen <br /> • <br /> determined that no permits had been issued for the alterations to the structure that <br /> are more fully described in section 10 below. <br /> 9. On June 17, 2016, a second Notice of Rescheduled Hearing was sent via first class <br /> mail and certified to the Respondent scheduling this matter before the Hearings <br /> Examiner on August 23, 2016. <br /> 10.
