Roberts dated February 14, 2013 Exhibit 12 Snohomish County Assessors Record dated February 14, 2013 Exhibit 13 Go Sync Map Exhibit 14 Exhibit List dated February 21, 2013 Based upon a review of the above record, the following Findings of Fact and Conclusions of Law hereby constitute the basis of the decision of the City of Everett Violations Hearing Examiner. FINDINGS OF FACT 1. Roberts Family Trust, Respondent, is the owner of record of property at 2102 McDougall Avenue, Everett, Washington (property). Barbara M. Roberts died February 3, 2005 and Gary L. Roberts died October 18, 2011. The property is in an R-2 Single Family Detached Medium Density zone as established by the City of Everett. On May 16, 2012, the City of Everett Code Enforcement (ECE) unit received a complaint from the City of Everett Police Patrol Division that an unsecured structure on the property was vacant and open to trespass. On May 16, 2012, ECE Officer Fagerstrom conducted an inspection of the property and observed and photographed that the residence appeared to be vacant and that overgrown vegetation could be viewed in the backyard of the property. On May 17, 2012, ECE Officer Fagerstrom contacted the neighbors of the property and was told that the son of the deceased parties may live in Yakima. ECE Officer Fagerstrom submitted a request to the City of Everett Police Department to attempt to locate the son. (Testimony of Code Enforcement Officer Fagerstrom) 4. On June 20, 2012, ECE Officer Fagerstrom spoke with Sgt. Bosman, City of Everett Police Department, and was told that while the Yakima Police had found two addresses for the son, they had been unable to locate him or to deliver any messages. On July 10, 2012, ECE Officer Fagerstrom received a City of Everett Police report which reported another break-in at the residence on the property.
