On August 8, 2012, ECE Officer Fagerstrom conducted an inspection of the <br /> property, at the request of the Everett Police Department, and observed and <br /> photographed bags of trash, garbage, household debris and overgrown vegetation <br /> in the rear yard of the property. The water to the property had been turned off. <br /> ECE Officer Fagerstrom posted a condemnation notice on the structure. On November 8, 2012, a violation citation was issued to the Respondent for <br /> violations of International Property Maintenance Code (IMPC) 108.1.5 as adopted <br /> by EMC 16.005.010 and Everett Municipal Code (EMC) 8.20.020(A)(C)(G). Copies <br /> were mailed to the Respondent via first class and certified mail to the Respondents <br /> last known address which ECE Officer Fagerstrom obtained from Snohomish <br /> County Assessors Record. Additionally, a copy of the citation was posted at the <br /> property. Pursuant to EMC 1.20.010.C.1, each method of service used is <br /> independently sufficient to provide for notice. The violation citation listed a <br /> corrective action date of February 4, 2013. The structure on site is neglected, damaged, dilapidated, unsecured and is an <br /> attractive nuisance to children who might play in the building or structure. It may <br /> become a harbor for vagrants, criminals or immoral persons, or enable someone to <br /> resort to the structure to commit a nuisance or an unlawful act. <br /> 8. On February 19, 2013, ECE Officer Fagerstrom conducted a follow-up inspection of <br /> the property and observed and photographed bags of trash, garbage, household <br /> debris and overgrown vegetation remained in the rear yard of the property. The City provided the Respondent with an opportunity to correct the conditions <br /> violating the EMC, provided a deadline of February 4, 2013 for corrective action, <br /> and provided notice of the date, time and place of this hearing. The Respondent <br /> failed to appear at the hearing. <br /> Based on the above Findings of Fact, the Violations Hearing Examiner enters the <br /> following Conclusions: <br />
