JANKELSON LACEYPARTNERSHIP
PO Box 98210
Lakewood, Washington 98496
(253) 405-0228
fax (253) 589-0486
November 2, 2012
Mr. Tony Lee
Debra Bryant
Building Official
Chief Administrative Office
City of Everett
City of Everett
3200 Cedar St.
2930 Wetmore Avenue
Everett, WA 98201
Everett, WA 98201
RE: 716 SE Everett Mall Way
Dear Tony and Debra,
This letter is to summarize my understanding of the steps forward which were mutually agreed as the means for
resolving the issues on this building. In the meeting yesterday I expressed to Debra and yourself that I appreciated
the attention you have given this since I contacted you about the initial stop work order and unlawful structure tag
that was posted on the building. You have been very responsive in sorting out the facts and history and getting down
to the few remaining issues, which are quite different than those originally posed. I do not agree with the
characterization that work has been done in the building without a permit. To the contrary, I think the history shows
that we, as owners, who acquired the building in 2001, have been extremely aware of doing work only with permits,
both is 2001 and 2008. As well as for the remodel/expansion on the Grocery Outlet Building, this is part of our
ownership of this parcel. I understand, as you do, that reconstructing history that now dates back more than a decade
is difficult and that City records may not be complete regarding certain work elements. Regardless of our different
positions regarding the status of past permits, and the work done pursuant to them, I agree that it is time to move
forward and deal with the actual few conditions in the building that are your concern. My understandings of these
steps are as follows:
1. We will arrange to have a structural engineer review the "live load" capacity of the 1000 +/-
square feet upper level, to determine if it meets the requirement to designate this area for
"storage." So there is no misunderstanding, please send me the floor plan with the
approximately 1000 square feet clearly designated. Secondly, we will have the structural
engineer review the shear wall requirement on the lower level
2. You will advise us of the maximum occupancy capacity of the upper level that would require
only one set of stairs so that one set of stairs could be blocked off from use.
3. The shower on the upper level will be removed and plumbing for the shower will be "capped
off".
4. If only one set of stairs will be required (item 2 above) we will "block" the larger set of stairs
from use and make the necessary adjustments to the remaining stairs to meet code.
5. We will install "exit signs" in locations as directed (hard wired with battery packs).
6. I believe that all exit doors presently have an "outward swing" but we will be sure that this is the
case.
Please let me know if I have covered all items that require our attention, or if I have misunderstood any of the above.
