EMC Title 19 Zoning, Chapter 7, Subsection 19.07.020.J and M <br /> AU of the exhibits are available for inspection at the Hearing Examiner's Office located at <br /> 2930 Wetmore Avenue, 8th floor, Everett, Washington. <br /> Based upon a review of the above, record, the following Findings of Fact and <br /> Conclusions hereby constitute the basis of the decision of the Everett Hearing <br /> Examiner. <br /> FINDINGS OF FACT <br /> 1. The Applicant requested approval of a variance from a development standard of <br /> the Everett Municipal Cade (EMC) Section 19.07.020.M(3) which prohibits <br /> accessory structures over 1,000 square feet from being located between the <br /> principal building and an adjoining street. The requested variance would allow a <br /> detached 1,496 square foot accessory structure to be located between the <br /> principal residence on the subject property and Highland Road. (exhibit 1, staff <br /> report, page 1; testimony of Mr. ingalsbe) <br /> 2. The subject property is zoned R-1, Single-Family Detached Low Density. The <br /> properties to the.north, south, east and west have the same zoning designation. <br /> (exhibit 1, staff report, page 1) <br /> 3. The property is developed with a single-family residence constructed in 1979 in a <br /> residential neighborhood. The lot was a rectangular shaped parcel narrow in the <br /> front that widened as it extended towards the back of the lot. The entire lot is <br /> 18,164 square feet and is mainly level With the back yard slopping from the rear <br /> of the house. Because the residence was built towards the rear of the lot, a large <br /> front yard and paved driveway were created. (exhibit 1, staff report, page 2; <br /> exhibit 2, topographical map; testimony of Mr. ingalsbe) <br /> 4. Itis the intent of the Applicant to construct a building that would house an indoor <br /> swimming lane. (exhibit 4, building plans; testimony of Mr. ingalsbe) The <br /> attached building would be 1,496 square feet or approximately 27 feet by 54 feet <br /> and 20 feet in height. Because the building is over 1,000 square feet and <br /> exceeds the maximum height standard for detached accessory buildings, a <br /> variance is required, (exhibit 1, staff report, page 2; testimony of Mn.
