• 1 Section 3. Shelter Operation; Impoundment, Release and Disposal. 2 A. The Director shall operate, maintain or provide an adequate facility to receive and care for any animal delivered to his/her custody for disposition 3 under provisions of this ordinance, which facility shall be accessible to the public during reasonable hours for the conduct of necessary business 4 concerning impounded animals. 5 B. Any animal may be impounded and held at the shelter when it is the subject of a violation of this ordinance, when an animal requires protective custody 6 and care for mistreatment or neglect by its lawful owner, or when otherwise ordered impounded by a court. 7 C. An animal is deemed to be impounded from the time the Director or his 8 designee takes physical custody of such animal. 9 D. Impoundment is subject to the following holding period and notice requirements: 10 1. Any animal wearing a current license tag from a jurisdiction within 11 Washington State shall be held for 144 hours (6 days) from time of impoundment; the impounding officer shall make reasonable effort by 12 telephone to give notice of the impoundment to the owner, and, if unsuccessful shall mail written notice to the last known address of 13 the owner advising of the impoundment and the date by which redemption must be made. 14 2. Any dog for which no identification or ownership is known or 15 determinable shall be held for 72 hours (3 days) from time of impoundment before any disposition may be made of such animal. 16 3. Dogs held for periods prescribed herein, and not redeemed by the 17 owner, become the property of the City of Everett. Cats, unless tagged, shall not be required to be held and become the property of 18 the City of Everett immediately upon receipt. 19 4. Animals delivered for impoundment by a peace officer who removed such animal from possession of a person in custody of the peace 20 officer shall be held for the period prescribed in subparagraph 1. 4 herein; a receipt shall be given to the person in custody from whom 21 the animal was taken; receipt shall recite redemption requirements and shall serve as the notice required herein. 22 E. 1. Any impounded animal shall be released to the owner or his 23 authorized representative upon payment of impoundment, care and license fees, if in the judgment of the Animal Control Officer in 24 charge such animal is not dangerous or unhealthy. 25 2. Any animal held for the prescribed period and not redeemed by its owner, and which is neither dangerous or unhealthy may be released for adoption, subject to the following conditions: 26 27 a. The adoptive owner agrees to furnish proper care to the animal in accord with this ordinance. 28 b. Payment of required fees, including any medical care costs incurred during impoundment. 29 c. In the case of a sexually reproductive animal, a spay/neuter 30 deposit for dogs and cats only, refundable upon display of evidence that such animal has been rendered sexually 31 unreproductive within the allotted time period, and 32
