• <br /> 1 Section 3. Shelter Operation; Impoundment, Release and Disposal. <br /> 2 A. The Director shall operate, maintain or provide an adequate facility to <br /> receive and care for any animal delivered to his/her custody for disposition <br /> 3 under provisions of this ordinance, which facility shall be accessible to the <br /> public during reasonable hours for the conduct of necessary business <br /> 4 concerning impounded animals. <br /> 5 B. Any animal may be impounded and held at the shelter when it is the subject <br /> of a violation of this ordinance, when an animal requires protective custody <br /> 6 and care for mistreatment or neglect by its lawful owner, or when otherwise <br /> ordered impounded by a court. <br /> 7 <br /> C. An animal is deemed to be impounded from the time the Director or his <br /> 8 designee takes physical custody of such animal. <br /> 9 D. Impoundment is subject to the following holding period and notice <br /> requirements: <br /> 10 <br /> 1. Any animal wearing a current license tag from a jurisdiction within <br /> 11 Washington State shall be held for 144 hours (6 days) from time of <br /> impoundment; the impounding officer shall make reasonable effort by <br /> 12 telephone to give notice of the impoundment to the owner, and, if <br /> unsuccessful shall mail written notice to the last known address of <br /> 13 the owner advising of the impoundment and the date by which <br /> redemption must be made. <br /> 14 <br /> 2. Any dog for which no identification or ownership is known or <br /> 15 determinable shall be held for 72 hours (3 days) from time of <br /> impoundment before any disposition may be made of such animal. <br /> 16 3. Dogs held for periods prescribed herein, and not redeemed by the <br /> 17 owner, become the property of the City of Everett. Cats, unless <br /> tagged, shall not be required to be held and become the property of <br /> 18 the City of Everett immediately upon receipt. <br /> 19 4. Animals delivered for impoundment by a peace officer who removed <br /> such animal from possession of a person in custody of the peace <br /> 20 officer shall be held for the period prescribed in subparagraph 1. <br /> 4 herein; a receipt shall be given to the person in custody from whom <br /> 21 the animal was taken; receipt shall recite redemption requirements <br /> and shall serve as the notice required herein. <br /> 22 E. 1. Any impounded animal shall be released to the owner or his <br /> 23 authorized representative upon payment of impoundment, care and <br /> license fees, if in the judgment of the Animal Control Officer in <br /> 24 charge such animal is not dangerous or unhealthy. <br /> 25 2. Any animal held for the prescribed period and not redeemed by its <br /> owner, and which is neither dangerous or unhealthy may be released <br /> for adoption, subject to the following conditions: <br /> 26 <br /> 27 a. The adoptive owner agrees to furnish proper care to the animal <br /> in accord with this ordinance. <br /> 28 b. Payment of required fees, including any medical care costs <br /> incurred during impoundment. <br /> 29 <br /> c. In the case of a sexually reproductive animal, a spay/neuter <br /> 30 deposit for dogs and cats only, refundable upon display of <br /> evidence that such animal has been rendered sexually <br /> 31 unreproductive within the allotted time period, and <br /> 32 <br />
