• <br /> 1 CHAPTER VII. ADMINISTRATION AND ENFORCEMENT <br /> 2 Section 1. Director Responsibility and Authority <br /> 3 A. It shall be the responsibility of the Director of Everett's Department of <br /> Animal Control and those he/she designates to enforce provisions of this <br /> 4 ordinance. <br /> 5 B. The Director may promulgate such rules and regulations as deemed <br /> necessary to implement, administer and enforce ordinance provisions. <br /> 6 <br /> C. The Director shall be empowered to exercise the authority of peace officers <br /> 7 to the extent necessary to enforce this ordinance, which power shall include <br /> issuance of citations, seizure and impoundment of animals subject to this <br /> 8 ordinance including pursuit onto City-owned property, vacant property and <br /> unenclosed private property and subsequent impoundment. <br /> 9 <br /> D. Persons designated by the Director to enforce this ordinance shall bear <br /> 10 satisfactory identification reflecting the authority under which they act, <br /> which identification shall be shown to any person requesting the same. <br /> 11 <br /> E. The Director may waive any of the standards for licensing of facilities as <br /> 12 he/she deems appropriate to meet peculiar requirements of a particular <br /> breed of animal. <br /> 13 <br /> F. The Director shall be authorized to reduce or waive any fee prescribed by <br /> 14 this ordinance except those related to licensing. <br /> 15 Section 2. Obstructing An Animal Control Officer Prohibited. <br /> 16 A. A person commits the offense of obstructing an Animal Control Officer if: <br /> 17 1. He or she intentionally uses or threatens to use force to obstruct a <br /> person that he or she knows or should reasonably know is an Animal <br /> 18 Control Officer and such officer is acting lawfully in a governmental <br /> function; or <br /> 19 <br /> 2. He or she intentionally does any act that he or she knows or should <br /> 20 reasonably know will interfere with or obstruct a person known to be <br /> or who should reasonably be known to be an Animal Control Officer <br /> 21 and such officer is acting lawfully in a governmental function. <br /> 22 B. It shall be unlawful for any person whom an Animal Control Officer has <br /> probable cause to believe has committed a violation of this ordinance to fail <br /> 23 to identify him/herself to such officer. <br /> 24 <br /> 25 <br /> 26 <br /> 27 <br /> 28 <br /> 29 <br /> 30 <br /> 31 <br /> 32 <br />
