• <br /> 1 B. The Director shall refund 50% of any fee paid upon denial of a license <br /> however, no refund shall be made upon revocation. <br /> 2 <br /> C. If an application for licensing is denied, or approved subject to <br /> 3 conditions, the applicant may appeal such denial or conditional <br /> approval upon filing a written request with the Director of Animal <br /> 4 Control within ten (10) days of the date such denial or conditonal <br /> approval was served upon him/her by certified mail. <br /> 5 <br /> D. Hearing upon such duly requested appeal shall be conducted before <br /> 6 the Animal Control Board within thirty (30) days of such request, with <br /> notice to the applicant by certified mail no later than ten (10) days <br /> 7 prior to the hearing. <br /> 8 E. The Director shall investigate any complaint concerning licensed <br /> facilities and, upon determination that a license should be revoked, <br /> 9 he/she shall serve written notice upon the licensee of such <br /> determination by certified mail and schedule a hearing at which the <br /> 10 licensee may appear and be heard; the hearing shall be public, and <br /> notice thereof shall be given the licensee within ten (10) days of the <br /> 11 date of such hearing. <br /> 12 F. If the Director confirms the revocation, the holder of a revoked <br /> license may appeal such revocation to the Animal Control Board upon <br /> 13 written request to the Director within ten (10) days after notice of <br /> the Director's confirmation of revocation given by certified mail; <br /> 14 failure to file a timely request shall terminate any appeal right, and <br /> the Director's decision revoking the license shall not be reviewable <br /> 15 otherwise. <br /> 16 G. Any person whose license is revoked shall, within ten days thereafter, <br /> humanely dispose of all animals owned, kept, or harbored by such <br /> 17 person and no part of the license fee shall be refunded. <br /> 18 CHAPTER V. RABIES CONTROL <br /> 19 In the event that any animal has bitten a human being or in the event that <br /> 20 the animal control agency has reason to suspect that an animal is rabid, the <br /> appropriate officials of the Snohomish Health District shall coordinate any <br /> 21 further activities within said health district. Snohomish Health District <br /> shall have jurisdiction over any matter possibly involving rabies. WAC 248- <br /> 22 100-450 and -451 and -452, together with amendments thereto, are <br /> incorporated by reference as set forth herein and prevail over any <br /> 23 conflicting provision of this title in any suspected rabies matter. <br /> 24 CHAPTER VI. PROHIBITED AND REGULATED CONDUCT <br /> 25 Section 1. Animal Owner Regulation <br /> 26 A. For purposes of this section, the term "permit" shall include human conduct <br /> 27 in relation to an owned or harbored animal which is intentional, deliberate, <br /> careless, inadvertent or negligent. <br /> 28 B. It shall be a violation of this ordinance for the owner of any animal to: <br /> 29 1. Permit any animal to become at large. Exception: Domestic cats. <br /> 30 2. Permit a domestic cat to trespass upon the property of another in <br /> such a manner as to be a nuisance. <br /> 31 <br /> 32 <br />
