• 1 B. The Director shall refund 50% of any fee paid upon denial of a license however, no refund shall be made upon revocation. 2 C. If an application for licensing is denied, or approved subject to 3 conditions, the applicant may appeal such denial or conditional approval upon filing a written request with the Director of Animal 4 Control within ten (10) days of the date such denial or conditonal approval was served upon him/her by certified mail. 5 D. Hearing upon such duly requested appeal shall be conducted before 6 the Animal Control Board within thirty (30) days of such request, with notice to the applicant by certified mail no later than ten (10) days 7 prior to the hearing. 8 E. The Director shall investigate any complaint concerning licensed facilities and, upon determination that a license should be revoked, 9 he/she shall serve written notice upon the licensee of such determination by certified mail and schedule a hearing at which the 10 licensee may appear and be heard; the hearing shall be public, and notice thereof shall be given the licensee within ten (10) days of the 11 date of such hearing. 12 F. If the Director confirms the revocation, the holder of a revoked license may appeal such revocation to the Animal Control Board upon 13 written request to the Director within ten (10) days after notice of the Director's confirmation of revocation given by certified mail; 14 failure to file a timely request shall terminate any appeal right, and the Director's decision revoking the license shall not be reviewable 15 otherwise. 16 G. Any person whose license is revoked shall, within ten days thereafter, humanely dispose of all animals owned, kept, or harbored by such 17 person and no part of the license fee shall be refunded. 18 CHAPTER V. RABIES CONTROL 19 In the event that any animal has bitten a human being or in the event that 20 the animal control agency has reason to suspect that an animal is rabid, the appropriate officials of the Snohomish Health District shall coordinate any 21 further activities within said health district. Snohomish Health District shall have jurisdiction over any matter possibly involving rabies. WAC 248- 22 100-450 and -451 and -452, together with amendments thereto, are incorporated by reference as set forth herein and prevail over any 23 conflicting provision of this title in any suspected rabies matter. 24 CHAPTER VI. PROHIBITED AND REGULATED CONDUCT 25 Section 1. Animal Owner Regulation 26 A. For purposes of this section, the term "permit" shall include human conduct 27 in relation to an owned or harbored animal which is intentional, deliberate, careless, inadvertent or negligent. 28 B. It shall be a violation of this ordinance for the owner of any animal to: 29 1. Permit any animal to become at large. Exception: Domestic cats. 30 2. Permit a domestic cat to trespass upon the property of another in such a manner as to be a nuisance. 31 32
