a <br /> 1 BEFORE THE CITY COUNCIL <br /> CITY OF EVERETT, STATE OF WASHINGTON <br /> 2 <br /> 3 <br /> 4 IN THE MATTER OF: ) FINDINGS OF FACT AND <br /> REZONE REQUEST ) CONCLUSIONS OF LAW <br /> 5 NO. 10-79 ) <br /> 6 <br /> 7 <br /> 8 THIS MATTER having come on regularly before the City Council of the City of <br /> 9 Everett pursuant to statute and ordinance, and the City Council after public hearing and <br /> 10 being fully advised, now makes the following: <br /> 11 <br /> 12 FINDINGS OF FACT <br /> 13 1. In June of 1978, an application for zoning reclassification (rezone request) <br /> 14 was received from Sybil and Gary Bales on behalf of themselves and other residents in <br /> 15 an area adjacent to the Lowell-Larimer Road. The requested rezone area is generally <br /> 16 described by the following boundaries: south of Franklin Street; west of the Lowell- <br /> 17 Larimer Road; north of 68th Street; and east of the Interstate 5 right-of-way. This <br /> 18 requested rezone area consisted of approximately 54.2 acres within the City limits of <br /> 19 the City of Everett. <br /> 20 2. The zoning classification of the subject properties at the time of the <br /> 21 rezone request was R-1, single-family residential, which allowed a single-family <br /> 22 structure on a 7,000 square foot lot. Said zoning classification had been in effect since <br /> 23 1962. <br /> 24 3. The rezone request was to change a portion of the 54.2 acres from R-1 to <br /> 25 R-S (Residential Suburban) and the remainder of the 54.2 acres from R-1 to A-1 <br /> 26 (Agricultural). An R-S zoning classification requires a minimum lot size of 12,500 <br /> 27 square feet; an A-1 zoning classification requires a minimum lot size of 217,800 square <br /> 28 feet. <br /> 29 4. The R-S zoning classification was to apply, generally, to those areas of <br /> 30 the 54.2 acres which topographically have slopes less than 15%; the A-1 zoning <br /> 31 classification applying, generally, to the areas with slopes of 15% or more. <br /> 32 <br />
