1 5. The rezone request was submitted to the Planning Commission pursuant to <br /> 2 applicable procedure. On November 1, 1978, the Planning Commission held a public <br /> 3 hearing which resulted in a favorable recommendation for the rezone request to the <br /> 4 City Council, with the proviso that the A-1 zoning classification should be an interim <br /> 5 zoning classification. <br /> 6 6. The City Council heard the rezone request pursuant to proper procedure <br /> 7 and public hearing and in December of 1978 granted the rezone request, with a small <br /> 8 area excepted, by ordinance and with Findings of Fact and Conclusions of Law. The <br /> 9 area excepted from the rezone request and maintained at an R-1 zoning classification is <br /> 10 described as follows: <br /> 11 <br /> Beginning at southwest corner 2nd and Franklin Street (Spring St.) true <br /> 12 point of beginning Smith First Addition, to the town of Lowell; thence <br /> southerly along the west margin of 2nd Street for 300 feet more or less; <br /> 13 thence angle right for 292 feet more or less; thence angle right for 300 <br /> feet to south margin of Franklin Street (Spring Street); thence angle right <br /> 14 for 292 feet more or less to true point of beginning. <br /> 15 <br /> The portion of the rezone area reclassified A-1 was done so on an interim basis to be <br /> 16 <br /> reconsidered by the City Council after the Planning Department had an opportunity to <br /> 17 <br /> develop a site-sensitive zoning ordinance proposal. The boundaries of the A-1 and R-S <br /> 18 <br /> zoning designations resulting from the City Council action are shown by Exhibit A <br /> 19 <br /> hereto and incorporated by reference as if fully set forth herein. <br /> 20 <br /> 7. On January 23, 1979, the City of Everett and the State of Washington <br /> 21 <br /> entered into an agreement which provides for public improvements designed to reduce <br /> 22 <br /> or eliminate drainage problems that have occurred as a result of the construction of the <br /> 23 <br /> Interstate 5 freeway to the west and uphill from the 54.2 acres of the rezone area. <br /> 24 8. On June 20, 1979, the City of Everett adopted Ordinance No. 610-79, <br /> 25 commonly referred to as the Steep Slope Ordinance. This ordinance regulates the <br /> 26 development on properties with topographical slopes of 15% or more to insure that such <br /> 27 development will be compatible with the specific site conditions and that density of <br /> 28 development will be controlled such that it is compatible with slope, soil types and <br /> 29 drainage conditions lessening potential problems for existing and future development on <br /> 30 both the steep slope properties and the adjacent lower level properties. <br /> 31 <br /> 32 <br /> -2- <br />
