• <br /> • <br /> • <br /> • <br /> 1 Section 1: Definitions <br /> 2 For the purpose of this chapter the following definitions shall <br /> apply: <br /> 3 <br /> A. "Alley" shall mean the minor portion of the public road network not <br /> 4 designed for general travel and used primarily as means of access <br /> to the rear of residences and business establishments. <br /> 5 <br /> B. "Alley improvement" shall mean the drainage, grading and <br /> 6 pavement facilities required to improve the alley to City design <br /> standards. <br /> 7 <br /> C. "City Engineer" shall mean the person appointed by the Mayor to <br /> 8 position of Engineering Department Head, or his designee. <br /> 9 D. "Right-of-Way" shall mean the public property used or reserved for <br /> municipal purposes including all public utilities and street usages. <br /> 10 <br /> E. "Street" shall mean all or any portion of the City public road <br /> 11 network open to the public for travel with exception of alleys and <br /> limited access highways designed as State Highways. <br /> 12 <br /> F. "Street Improvements" shall mean the installation of all public <br /> 13 facilities required to improve the street to City design standards <br /> including grading, drainage, pavement, curb/gutter, sidewalk, <br /> 14 street lights, traffic signals and other necessary appurtenances. <br /> Such street improvements shall not be limited to the half street <br /> 15 abutting the property; for example, where no permanent street <br /> improvement existed, the street improvement shall be extended <br /> 16 beyond the centerline a sufficient distance (10 ft. minimum) to <br /> permit safe movement of traffic. <br /> 17 <br /> G. "Interim Street Improvements" shall mean the installation of <br /> 18 improvements to bring the public facility up to the existing <br /> character of the surrounding streets and pedestrian facilities and <br /> 19 may include widening of or installation of the asphalt street <br /> surface, gravel shoulder, temporary drainage facilities and in case <br /> 20 of alleys, an all weather gravel driving surface. <br /> 21 <br /> Section 2: Ordinance No. 555-78, Section 2, which reads as follows: <br /> 22 <br /> 23 Section 2: Applicability <br /> 24 No building permit shall be issued by the City of Everett for <br /> construction of any new building or facility of any kind or description, or <br /> 25 in connection with any additions, alterations or repairs within any twelve <br /> (12) month period which exceeds fifty percent (50%) of the current market <br /> 26 value of an existing building or facility on the property, unless or until the <br /> public streets and alleys upon which the same abuts shall be improved at <br /> 27 the owner(s) expense in accordance with the following requirements: <br /> 28 A. All business, commercial, industrial, and multiple family residential <br /> land uses shall be required to construct street and/or alley <br /> 29 improvements together with all necessary appurtenances; provided, <br /> however, at the discretion of the City Engineer when he is satisfied <br /> 30 that adequate improvements exist except for nominal lacking of <br /> street width, a local improvement district (L.I.D.) covenant, <br /> 31 <br /> 32 <br /> -2- <br />
