Forms for the L.I.D. covenant or bond are to <br /> 2 be approved by the City Attorney. <br /> 3 B. All single family residential uses, including duplexes, where in the <br /> opinion of the City Engineer, the existing street improvements can <br /> 4 adequately serve the property in the short term future, shall be <br /> required to provide a recorded covenant Power of Attorney in <br /> 5 support of a ppetition local improvement district (L.I.D.) for <br /> construction of street and alley improvements together with all <br /> 6 necessary appurtenances; provided, however, at the discretion of <br /> the City Engineer where inadequate or no public street and/or alley <br /> 7 improvements exist, the property owner may be required to provide <br /> any and all construction requirements herein. <br /> 8 <br /> C. All owners of properties shall dedicate additional rights-of-way as <br /> 9 necessary to complete the required street improvements in <br /> accordance with City Standards; provided, however, that the <br /> 10 Developer shall still be required to meet the appropriate setback <br /> requirements as well as all other applicable performance standards. <br /> 11 <br /> D. All improvements required above shall be extended as necessary to <br /> 12 provide a smooth transition with existing improvements, both <br /> laterally across the street and longitudinally up and down the <br /> 13 street, for drainage, vehicular and pedestrian traffic. <br /> 14 <br /> is hereby amended to read: <br /> 15 <br /> 16 Section 2: Applicability <br /> 17 No building permit shall be issued by the City of Everett for <br /> construction of any new building or facility of any kind or description, or <br /> 18 in connection with any additions, alterations or repairs within any twelve <br /> (12) month period which exceeds fifty percent (50%) of the current market <br /> 19 value of an existing building or facility on the property, unless or until the <br /> public streets and alleys upon which the same abuts shall be improved at <br /> 20 the owner(s) expense in accordance with the following requirements: <br /> 21 A. All business, commercial, industrial, and multiple family residential <br /> land uses shall be required to construct street and/or alley <br /> 22 improvements together with all necessary appurtenances; provided, <br /> however, at the discretion of the City Engineer when he is satisfied <br /> 23 that adequate improvements exist except for nominal lacking of <br /> street width, a recordable covenant which consents to the <br /> 24 formation of a local improvement district (L.I.D.) and constitutes a <br /> waiver of protest to the formation of such a local improvement <br /> 25 district (hereinafter referred to as "L.I.D. covenant") may be <br /> substituted for any and all construction requirements herein. <br /> 26 Forms for the L.I.D. covenant shall be provided by the City and <br /> approved by the City Attorney. <br /> 27 <br /> B.
