ORDINANCE NO. (, 6 9 _r6) <br /> An Ordinance repealing the existing <br /> Nonconforming Use Section 5.B of <br /> Ordinance No. 3572 of the Everett <br /> Municipal Code, Title 19, EMC 19.56 <br /> and adopting these revised Nonconforming <br /> Use Regulations. <br /> WHEREAS, on December 18, 1979, the Planning Commission held a <br /> public hearing regarding the repeal of the existing Nonconforming Use <br /> Section and adoption of a revised Nonconforming Use Section of the <br /> Everett Zoning Code EMC 19.56; and <br /> WHEREAS, the City Council of Everett, after hearing the recom- <br /> mendations of the Planning Commission of the City of Everett has <br /> determined that said changes to the Nonconforming Use regulations <br /> shall be made, <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That the Nonconforming Use Section 5.B of Ordinance No. 3572 <br /> is hereby repealed and the following revised Nonconforming Use <br /> regulations inserted in place to read as follows: <br /> A. DECLARATION OF PURPOSE, SCOPE AND AUTHORITY <br /> 1) The purpose of the Nonconforming Use Permit is to regulate <br /> uses which do not meet the requirements of the Zoning Ordinance. <br /> 2) The Authority for granting a Nonconforming Use Permit shall <br /> rest with the Planning Director, based upon the data required <br /> in Paragraph H.1) of this Section. <br /> 3) The authority to grant an expansion of a Nonconforming Use <br /> per the requirements of this chapter shall rest with the Board <br /> of Adjustment/Hearing Examiner. <br /> B. GENERAL PROVISIONS <br /> No building, structure, or premises shall hereafter be used or <br /> occupied and no building or part thereof shall be erected, moved, re- <br /> constructed, extended, enlarged, or altered, except in conformity with <br /> the regulations of this Chapter. <br />
