g. In those cases involving substantial work on <br /> public property, the City may require the <br /> applicant to take out and maintain during the <br /> life of the permit Public Liability insurance <br /> with a limit of not less than $100, 000 for all <br /> damages arising out of injuries to or death of <br /> one person and with a total limit of not less <br /> than $200 , 000 for damages arising out of injuries <br /> to or death of two or more persons in one acci- <br /> dent, and also Property Damage insurance with <br /> limits of $100, 000 for all damages arising out <br /> of injuries to or death of one person with a <br /> total limit of not less than $200, 000 for damages <br /> arising out of injuries to or death of two or <br /> more persons in one accident. Insurance shall <br /> cover work done by the applicant and shall protect, <br /> as named insured, the City and all City officials <br /> and employees from suits or claims for damages <br /> arising from operations under the permit or actions <br /> of the applicant either direct or indirect. <br /> 2 . Any work done without or contrary to the provisions of <br /> the permit shall be the liability of the party doing <br /> the work, and the Director shall have the right to <br /> confiscate undesirable plants and assess charges for <br /> labor, equipment and materials for any work done by the <br /> Park Department to correct the situation against the <br /> party who obtained the permit. This shall not preclude <br /> the City from pursuing any other legal remedies which <br /> may be appropriate. <br /> C. Trimming or Removal. Trees may be trimmed or removed <br /> only for the following reasons: <br /> 1. Danger to the public safety exists and cannot be <br /> remedied by pruning or other methods, or <br /> 2 . Disease or insect infestation is present in trees <br /> which may spread to other trees or plants, or <br /> 3. Tree is interferring with or damaging public utilities <br /> and cannot be corrected by pruning or other methods, or <br /> 4 . Any trees to be removed for construction reasons will <br /> be handled on an individual basis by the Parks Director <br /> or his designee. <br /> 5. Trees which are sight obscuring will be handled on an <br /> individual basis by the Parks Director or his designee <br /> as set forth in the City of Everett' s Tree Policy. <br /> Section 4 : GUIDELINES. <br /> A. Selection of trees to be planted on rights-of-way and <br /> public property shall be determined from the City of <br /> Everett' s list of approved species . Selection within the <br /> list will be determined by the Director and City Engineer <br /> upon consideration of environmental factors, compatibility <br /> with existing vegetation, maintenance requirements, and <br /> availability of replacement stock. <br /> - 3 - <br />
