i <br /> DEVELOPMENT CONTRACT <br /> FOR <br /> JADE DEVELOPMENT <br /> PLANNED RESIDENTIAL DEVELOPMENT <br /> As Revised September 9, 1980 <br /> Final development Plan Approval and subsequent issuance of construction permits for <br /> the Jade Development PRD on the parcel described in Rezone Ordinance No. 639-79 <br /> shall not occur until the following have been satisfied: <br /> CONDITIONS <br /> 1. The final site plan shall consist of the following elements: <br /> I � <br /> (a) Up to 75 units in 75 structures with minimum lot size 3,000 square feet <br /> and minimum width 30 feet. Siting of units on lots and relationship to <br /> adjacent units. <br /> (b) A public street (cul-de-sac) off Third Avenue. <br /> (c) Private roads off the cul-de-sac to serve four subareas <br /> (d) 24 guest parking spaces <br /> (e) 4.2 acres of open space adjacent to the creek. <br /> (f) A 6-foot fence plus landscaping for perimeter screening. <br /> 2. That a detailed final landscaping plan be <br /> submitted to the Planning Department <br /> prior to any site work, showing the following: <br /> a. The trees to be retained in the open space area, and any supplemental <br /> planting needed to enhance the character of this portion of the site. <br /> b. The typical landscaping detail of each subarea and lot, including yard <br /> areas of each lot with particular attention given to the windowless wall <br /> areas as they relate to adjacent units. <br /> c. A typical section of the perimeter screening showing the fencing and <br /> landscaping in selected areas as determined by the Planning Department, <br /> and 25-foot setback on the entire perimeter. <br /> d. Specifics on how the creek area will be cleaned up and visually enhanced. <br /> e. Identity of the area and general nature of the active open space area. <br /> 3. That a phasing plan be submitted prior to final approval. <br /> 4. Off-Site Improvements: Third Avenue, adjacent to the project, shall be <br /> improved to City standards with 22 feet of paving; with curb, gutter, and <br /> sidewalk on the east side. Third Avenue, from the northwest corner of the <br /> project to Broadway, shall be improved to 22 feet of paving. <br /> 5. Internal Public Road: The access off Third Avenue into the project will be on • <br /> 30 feet of right of way; 24 feet of paving, curb and gutter; with sidewalk on one <br /> side constructed per attached specifications. (see Attachment A) <br /> 6. Private Roads: These shall be constructed to a width of 24 feet with a curb <br /> between the road and parking area, and constructed per attached specifications. <br /> (See Attachment A). <br /> 7. Utilities: All water and sewer improvement designs shall be reviewed by Public <br /> Works per standards and layout which provide for reasonably long term <br /> durability and ease of maintenance. The City and Jade Development and or <br /> assigns agree that the parties will enter into a latecomers agreement in <br /> accordance with Ordinance No. 7-11-80 to allow Jade Development and or <br /> assigns to recover costs from other property owners who connect to the water <br /> and sewer improvements constructed by Jade Development and or assigns and <br /> benefit from such improvements. <br />
