1 ORDINANCE NO. ,3/ 79' 2 3 AN ORDINANCE levying a charge for costs of construction of a water main and fire hydrants to serve certain property located in the area of 4 Tereve Drive and Rainier Drive. 5 6 7 WHEREAS, the City Council, pursuant to Resolution No. 1489, attached hereto 8 and incorporated by reference herein, has ordered the improvement of the Water 9 Distribution System of the City of Everett; and 10 WHEREAS, these improvements have been constructed by the City of Everett; 11 and 12 WHEREAS, the City finds that the owners of property to be served by the 13 improvements will be benefitted thereby; and 14 WHEREAS, the City and certain property owners in the area served by the 15 improvements have paid for the cost of construction of these improvements, with the 16 City expecting to be reimbursed for a portion of its construction costs from those 17 benefitted property owners who have not contributed to the cost of said improvements; 18 and 19 WHEREAS, the City may, pursuant to RCW 35.92.025, levy a reasonable 20 connection charge on property owners benefitted by water system improvements in 21 order that such property owners shall bear their equitable share of the cost of such 22 improvements; and 23 WHEREAS, the City finds that the following charges are reasonable and 24 represent an equitable share of the actual cost of such improvements; 25 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: 26 Section 1: Notwithstanding other financing methods for water distribution 27 system improvements (as provided in EMC 14.16.050), after July 5, 1978, an additional 28 connection surcharge of $14.40 per lineal frontage foot shall be charged to the owners 29 of the below described property: 30 31 32
