G. The determination appealed from shall be regarded as prima facie <br /> correct and the burden of establishing the contrary shall be upon <br /> the appealing party. Further, the City Council shall give considera- <br /> tion to the recommendation made by the Environmental Review Committee. <br /> H. The Environmental Review Committee and the City Council shall <br /> have authority upon good cause to grant continuances of hearings <br /> not to exceed fourteen days and further the City Council shall <br /> have authority to affirm, reverse or modify in whole or in part <br /> the administrative determinations of the Responsible Official; <br /> to remand cases to the Responsible Official with directions for <br /> further proceedings; and to grant other appropriate relief in <br /> the circumstances. All decisions of the Environmental Review <br /> Committee shall be written and shall contain findings of fact <br /> and conclusions of law. <br /> I. The Environmental Review Committee is further authorized to establish <br /> and promulgate rules and procedures to implement the provisions <br /> thereof, which rules shall be submitted to the City Council for <br /> approval. <br /> J. Any determination not so appealed shall become final in accordance <br /> with this ordinance and any order so appealed shall not become <br /> final until affirmed or modified by the City Council. <br /> Section 20. - Notice/Statute of Limitations <br /> A. The City, applicant for, or proponent of an action may publish <br /> notice of action pursuant to RCW 43.21C.080 for any action. <br /> B. The form of the notice shall be as prescribed by the Department <br /> of Ecology and/or substantially in the form and manner set forth <br /> in RCW 43.21C.080. The notice shall be published by the City <br /> Clerk, applicant or proponent pursuant to RCW 43.21C.080. <br /> Section 21. - Severability <br /> If any provision of this ordinance or its application to any person or <br /> circumstance is held invalid, the remainder of this Ordinance, or the applica- <br /> tion of the provisions to other persons or circumstances, shall not be affected. <br /> Mayor <br /> ATTEST: <br /> 4City Clerk <br /> PASSED: 7 ' ? <br /> PUBLISHED: a <br /> VALID: - / 5 _ , <br /> -21- <br />
