2. A determination as to scope of the total proposal; <br /> 3. A determination whether or not a project or proposal is cate- <br /> gorically exempt; <br /> 4. A threshold determination; <br /> 5. Adoption of the Final EIS, as to adequacy; <br /> 6. The issuance of a document denying or conditioning an action <br /> based upon specific adverse environmental impacts; <br /> 7. Final action on a project or proposal, as to compliance with <br /> the provisions of this Ordinance. <br /> 8. A determination to exclude or remove a consultant from the <br /> consultant list. <br /> B. Any person aggrieved by any of the determinations or actions described <br /> in Subsection "A" above, may appeal such determination or action. <br /> There shall be no right under this section to appeal to the Environ- <br /> mental Review Committee any decisions of the City Council. <br /> C. Notice of all determinations and actions described in Subsection "A" <br /> above shall be filed immediately by the Responsible Official in <br /> the City's SEPA Public Information Center. Any appeal from such <br /> a determination or action must be filed in writing with the Environ- <br /> mental Review Committee no later than the fifteenth day following <br /> the filing of such determination or action and shall set forth <br /> in a clear and concise manner the errors complained of. <br /> D. Upon timely notice of appeal as to any determination or action <br /> set out in Subsection "A" of this section, the Environmental Review <br /> Committee shall set a date for hearing, which shall be not less <br /> than four nor more than fifteen days after receipt of such notice. <br /> Within five days after such hearing, the Environmental Review <br /> Committee shall file and transmit to the parties written findings <br /> of fact and their conclusions as recommendations to the City Council. <br /> E. Within seven days of the filing and transmittal of the written <br /> findings of fact and conclusions of law of the Environmental Review <br /> Committee, the City Council shall set a hearing for presentation <br /> which shall be not less than seven nor more than fifteen days <br /> from the date such hearing is set. The purpose of the hearing <br /> before the City Council is for presentation of the Environmental <br /> Review Committee's findings of fact, conclusions of law, and recommended <br /> decision. The parties will be allowed argument. The City Council <br /> shall have the discretion to re-open the testimonial or evidentiary <br /> record upon a showing of good cause. The City Council may affirm, <br /> reverse or modify the recommended decision of the Environmental <br /> Review Committee. Within seven days after such hearing, the City <br /> Council shall file and transmit to the parties, written findings <br /> of fact and conclusions of law and its decision. <br /> F. Notice of hearings shall be sent by certified mail to the parties <br /> concerned and published in a newspaper of general circulation <br /> as required by the administrative code for hearings in contested <br /> cases. <br /> -20- <br />
