7 Jci 1 ORDINANCE NO. '7 7-7? 2 AN ORDINANCE providing for the vacation of Wetmore Avenue lying 3 between 13th Street and 14th Street. 4 5 WHEREAS, on December 13, 1978, the City Council held a public hearing on the 6 vacation of that portion of Wetmore Avenue lying between 13th Street and 14th Street; 7 and 8 WHEREAS, due and legal notice of the time and place of said public hearing had 9 been given by the City Clerk in the manner prescribed by law; and 10 WHEREAS, at said public hearing all persons present who desired to speak in 11 favor or against said vacation were afforded the opportunity; and 12 WHEREAS, in its determination pursuant to said public hearing, the City Council 13 finds a public benefit in vacating said portion of Wetmore with the additional as well as 14 improved services which will be available at Everett General Hospital through 15 utilization of the vacated area; and 16 WHEREAS, the portion of Wetmore Avenue proposed to be vacated does not abut 17 on a body of salt or fresh water; 18 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: 19 Section 1: All that portion of Wetmore Avenue lying between Thirteenth 20 Street (13th Street) and Fourteenth Street (14th Street) also known as: 21 All that portion of Wetmore Avenue lying west of Block 246 and east of 22 Block 247 Plat of Everett Division "R" according to the Plat, thereof recorded in Volume 6 of Plats, page 33, records of Snohomish County, 23 Washington. 24 be and the same shall be vacated according to the terms and conditions of this 25 ordinance. 26 27 Section 2: The City of Everett shall retain an easement to construct, operate, 28 maintain, repair and replace all public utilities under, over and across all of said 29 vacated property.
