7 Jci <br /> 1 ORDINANCE NO. '7 7-7? <br /> 2 <br /> AN ORDINANCE providing for the vacation of Wetmore Avenue lying <br /> 3 between 13th Street and 14th Street. <br /> 4 <br /> 5 WHEREAS, on December 13, 1978, the City Council held a public hearing on the <br /> 6 vacation of that portion of Wetmore Avenue lying between 13th Street and 14th Street; <br /> 7 and <br /> 8 WHEREAS, due and legal notice of the time and place of said public hearing had <br /> 9 been given by the City Clerk in the manner prescribed by law; and <br /> 10 WHEREAS, at said public hearing all persons present who desired to speak in <br /> 11 favor or against said vacation were afforded the opportunity; and <br /> 12 WHEREAS, in its determination pursuant to said public hearing, the City Council <br /> 13 finds a public benefit in vacating said portion of Wetmore with the additional as well as <br /> 14 improved services which will be available at Everett General Hospital through <br /> 15 utilization of the vacated area; and <br /> 16 WHEREAS, the portion of Wetmore Avenue proposed to be vacated does not abut <br /> 17 on a body of salt or fresh water; <br /> 18 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 19 Section 1: All that portion of Wetmore Avenue lying between Thirteenth <br /> 20 Street (13th Street) and Fourteenth Street (14th Street) also known as: <br /> 21 <br /> All that portion of Wetmore Avenue lying west of Block 246 and east of <br /> 22 Block 247 Plat of Everett Division "R" according to the Plat, thereof <br /> recorded in Volume 6 of Plats, page 33, records of Snohomish County, <br /> 23 Washington. <br /> 24 <br /> be and the same shall be vacated according to the terms and conditions of this <br /> 25 <br /> ordinance. <br /> 26 <br /> 27 Section 2: The City of Everett shall retain an easement to construct, operate, <br /> 28 maintain, repair and replace all public utilities under, over and across all of said <br /> 29 vacated property. The City of Everett further retains the right to grant to public and <br /> 30 private utilities the right to construct, operate, maintain, repair and replace utility <br /> 31 <br /> 32 <br />
