II. Scope of Work <br /> 1. Effect of Ordinance, Policies, Procedures, Rules and Regulations <br /> The Facility will be administered by the County in accordance with the ordinance, <br /> policies, procedures, rule and regulations of the County and in accordance with <br /> Washington State law. The City and the City's detainee's shall be subject to the <br /> County's ordinances, policies, procedures, rules, and regulations relating to Facility <br /> operations, PROVIDED, HOWEVER, that nothing in this Agreement shall be <br /> construed as creating, modifying, or expanding any duty on the party of the County <br /> except as specifically provided herein. Nothing in this Agreement shall be interpreted <br /> as a delegation by the City, its judicial and law enforcement agencies, to the County <br /> of the duty to supervise City detainees. <br /> 2. Detention. <br /> The County will provide secure custody/detention for juveniles detained pursuant to <br /> Washington State law, including but not limited to RCW 13.04.030, in accordance <br /> with the rules, policies, and procedures governing the detention of juveniles. This <br /> Agreement is limited to detention of juveniles for offenses which are within the <br /> jurisdiction of the City's Municipal Court under RCW 13.040.030(1) (e) (iii), and are <br /> charged within said court. All youth held within the juvenile facility on offenses <br /> otherwise subject to the jurisdiction of other courts, including but not limited to <br /> Snohomish County Superior Court, are not governed by this Agreement. <br /> 3. Admission <br /> A. When the City is the arresting agency for any offense subject to the jurisdiction of <br /> the City's Municipal Court, the City certifies, by the act of presenting a youth for <br /> detention, that the youth is legally detainable. <br /> i. Absent proper documentation providing a legal basis for confining the <br /> City detainee, the County will have no obligation to receive the City <br /> detainee into custody. Proper documentation for purposes of this <br /> section includes warrants of arrest, bench warrants, charging <br /> documents and statements of probable cause and /or any other intake <br /> forms required by the County. <br /> 2 <br />
