It <br /> CONCOMITANT AGREEMENTS TO ORDINANCE NO 573-78 <br /> AGREEMENT <br /> THIS AGREEMENT, made and entered into this 20 day of December 1978, <br /> by and between the City of Everett, a municipal corporation, hereinafter <br /> called the City, and the Reininga Corporation, hereinafter called the <br /> Company, Witnesseth: <br /> WHEREAS, the Company has made application to the City for a <br /> change in the zoning classification of the land bounded by <br /> 75th Street and Evergreen Way, located in the City of Everett, <br /> Washington, from R-3 Multiple-Family Low-Density Residential <br /> to B-2, Community Business, and, <br /> WHEREAS, the said rezoning contemplated herein will necessitate <br /> additional street improvements, dedication of right-of-way and <br /> mitigating measures to address impacts of the project, as detailed <br /> herein, and, <br /> WHEREAS, it is recognized by the parties that the City would not <br /> commit itself to the expenditure of funds required for the street <br /> improvements and further recognized that said rezoning is absolutely <br /> conditional and dependent upon the completion of the conditions <br /> contained in this agreement, and, <br /> NOW, THEREFORE, in consideration of the City Council of the City of <br /> Everett, changing the classification of the above described property from <br /> the "R-3" Multiple-Family Low-Density Residential Zone to a "B-2" Community <br /> Business Zone, the Company hereby agrees to meet the following conditions: <br /> 1. That Phase I (10 acres) consisting of the supermarket; <br /> 35,000 square feet of shop spaces; 20,000 square feet of <br /> satellite shop space; and 12,385 square feet of pad use <br /> be permitted per the site plan as modified by the <br /> following conditions. <br /> 2. That Phase II (9 acres) consisting of the Business Park, shopping <br /> center or residential not be allowed until direct access from <br /> Evergreen Way at approximately 77th Street is secured and until <br /> site plan review by Planning Commission and City Council. <br />
