• • • 1 ORDINANCE NO. _4-411' if 2 AN ORDINANCE amending the Noise Control Ordinance (Ordinance No. 3 534-78) to conform with State regulations. 4 5 WHEREAS, the City of Everett enacted a Noise Control Ordinance on July 19, 6 1978; and 7 WHEREAS, RCW 70.107.060 requires that all Noise Control Ordinances must be 8 approved by the Department of Ecology of the State of Washington; and 9 WHEREAS, by letter the Department of Ecology has advised the City that its 10 Noise Control Ordinance is acceptable provided four minor changes are made; 11 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: 12 Section 1: Section 6 (b) (3) of Ordinance No. 534-78 which reads: 13 14 b. The following sources of noise are exempt or partially exempt from the provisions of this ordinance: 15 * * * 16 3. Noise emanating from the temporary construction 17 sites except between the hours of 10:00 p.m. and 7:00 a.m. on weekdays and 10:00 p.m. and 9:00 a.m. on 18 weekends if the receiving property is located in District I of the City of Everett. 19 20 is hereby amended to read as follows: 21 b. The following sources of noise are exempt or partially exempt from 22 the provisions of this ordinance: 23 * * * 24 3. Noise emanating from marine-oriented construction sites except between the hours of 10:00 p.m. and 6:00 31 a.m. on weekdays and weekends if the receiving property is located within District I of the City of 32 Everett.
