1 ORDINANCE NO. 5''6o 7, 2 AN ORDINANCE licensing and regulating vehicle wrecker or towing 3 service; requiring insurance policies to protect the public; providing for investigation and supervision by the Chief of Police; setting forth 4 duties of licensees; providing for revocation of licenses; and proscribing penalties for the violation of its provisions. 5 6 7 WHEREAS, it is in the best interest of the City to regulate tow truck operators 8 within its corporate limits; 9 Section 1: DEFINITIONS. 10 A. "Towing business" or "towing service" includes any person, corporation, 11 partnership, joint venture or other business entity which owns and/or operates one or 12 more tow trucks within the corporate limits of the City of Everett. 13 B. "Tow truck" means any vehicle designed or intended to tow vehicles which 14 are disabled by mechanical failure or physical damage or being impounded pursuant to 15 law. 16 C. "Impound" means the taking of a vehicle into legal custody, pursuant to 17 law. 18 D. "Police" means any authorized agent of the Everett Police Department or 19 other law enforcement agency having jurisdiction. 20 E. "Police Department" means the Police Department of the City of Everett. 21 F. "City" means City of Everett. 22 G. "Licensee" means a towing service having a valid license issued by the 23 City of Everett authorizing the furnishing of towing services. 24 25 Section 2: LICENSE REQUIRED. 26 It is unlawful for any person, corporation, partnership, joint venture or other 27 business entity to operate a towing business or towing service within the corporate 28 limits of the City of Everett without first obtaining a license therefor issued by the 29 City. Such license shall not be transferable end upon a sale or other transfer of the 30 towing business, a new license must be obtained as provided in this ordinance. The fa, 31 32
