1 ORDINANCE NO. 5''6o 7, <br /> 2 <br /> AN ORDINANCE licensing and regulating vehicle wrecker or towing <br /> 3 service; requiring insurance policies to protect the public; providing <br /> for investigation and supervision by the Chief of Police; setting forth <br /> 4 duties of licensees; providing for revocation of licenses; and <br /> proscribing penalties for the violation of its provisions. <br /> 5 <br /> 6 <br /> 7 WHEREAS, it is in the best interest of the City to regulate tow truck operators <br /> 8 within its corporate limits; <br /> 9 Section 1: DEFINITIONS. <br /> 10 A. "Towing business" or "towing service" includes any person, corporation, <br /> 11 partnership, joint venture or other business entity which owns and/or operates one or <br /> 12 more tow trucks within the corporate limits of the City of Everett. <br /> 13 B. "Tow truck" means any vehicle designed or intended to tow vehicles which <br /> 14 are disabled by mechanical failure or physical damage or being impounded pursuant to <br /> 15 law. <br /> 16 C. "Impound" means the taking of a vehicle into legal custody, pursuant to <br /> 17 law. <br /> 18 D. "Police" means any authorized agent of the Everett Police Department or <br /> 19 other law enforcement agency having jurisdiction. <br /> 20 E. "Police Department" means the Police Department of the City of Everett. <br /> 21 F. "City" means City of Everett. <br /> 22 G. "Licensee" means a towing service having a valid license issued by the <br /> 23 City of Everett authorizing the furnishing of towing services. <br /> 24 <br /> 25 Section 2: LICENSE REQUIRED. <br /> 26 It is unlawful for any person, corporation, partnership, joint venture or other <br /> 27 business entity to operate a towing business or towing service within the corporate <br /> 28 limits of the City of Everett without first obtaining a license therefor issued by the <br /> 29 City. Such license shall not be transferable end upon a sale or other transfer of the <br /> 30 towing business, a new license must be obtained as provided in this ordinance.
