{ <br /> • <br /> 1 4. A "Class A" licensee must have a storage yard and place of business within <br /> 2 the corporate limits of the City. <br /> 3 <br /> 4 Section 16: FEES. <br /> 5 The Police Chief is hereby authorized to develop a schedule of maximum fees for <br /> 6 towing services requested by the Everett Police Department or its dispatcher. Any <br /> 7 "Class A" licensee shall not exceed the fees of such schedule for services rendered at <br /> 8 the request of the Everett Police Department or its dispatcher. Charging fees <br /> 9 exceeding those of the fee schedule or charging for services not actually rendered may <br /> 10 result in suspension from the list of "Class A" licensees authorized for police impounds. <br /> 11 The Mayor shall approve such schedule of maximum fees before its implementation by <br /> 12 the Police Chief. The schedule of maximum fees may be adjusted periodically by the <br /> 13 Chief of Police, upon the approval of the Mayor. <br /> 14 <br /> 15 Section 17: SEVERABILITY. <br /> 16 If any one or more of the provisions, sections, covenants or agreements provided <br /> 17 in this ordinance to be performed by the City shall be declared by any court of <br /> 18 competent jurisdiction to be contrary to law, then such provision, section, covenant or <br /> 19 agreement shall be null and void and shall be deemed separable and the remaining <br /> 20 provisions, sections, covenants or agreements in this ordinance and shall in no way <br /> 21 affect the validity of the other provisions of this ordinance. <br /> 22 <br /> 23 Section 18: NO VESTED RIGHT TO DO POLICE IMPOUNDS. <br /> 24 Nothing in this ordinance shall proscribe the City from contracting with one or <br /> 25 more tow operators for tow services requested by the police and/or providing such <br /> 26 towing services with City personnel and equipment. It is the intent of this ordinance to <br /> 27 establish certain requirements for tow business licensees and those licensees authorized <br /> 28 to do police impounds, but not to vest any specific rights to do police impounds or other <br /> 29 police requested towing services. <br /> 30 <br /> 31 <br /> 32 Page -11- <br />
