1 ORDINANCE NO.,5 6 7— 7f <br /> 2 <br /> 3 AN ORDINANCE establishing at .3% the local sales and use tax for transit <br /> purposes; for which a maximum rate of .3% was authorized by <br /> 4 the Everett City Council by Ordinance No. 523-78 and approved <br /> by a majority of the voters of Everett on September 19, 1978, <br /> 5 and declaring an emergency to exist. <br /> 6 WHEREAS, Ordinance No. 523-78 of the City of Everett established, <br /> 7 pursuant to R.C.W. 82. 14.045, a sales and use tax for public transportation <br /> 8 purposes to be imposed within the City of Everett at a maximum rate of .3% <br /> 9 to replace the existing household and employee tax; and <br /> 10 WHEREAS, said Ordinance No. 523-78 referred the matter of said sales <br /> 11 and use tax to a vote of the people of Everett to be held on September 19, 1978 <br /> 12 and conditioned the imposition of such tax on approval by at least a majority <br /> 13 of those voting thereon; and <br /> 14 WHEREAS, a majority of the voters of the City of Everett voting on <br /> 15 that date did approve the establishment of such a tax within the City of <br /> 16 Everett to replace the existing household and employee tax; and <br /> 17 WHEREAS, it is necessary that the City Council of the City of <br /> 18 Everett set the rate at which said tax should be set at present in order to <br /> 19 adequately support the needs of the Everett Transit System. <br /> 20 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> 21 EVERETT: <br /> 22 Section 1 . That the local sales and use tax for transit purposes, <br /> 23 as conditionally approved by the Everett City Council in Ordinance 523-78, is <br /> 24 hereby established and imposed within the City of Everett at the rate of .3 <br /> 25 of one percent of the selling price (in the case of the sales tax) or value of <br /> 26 the article used (in the case of the use tax) . <br /> 27 Section 2. The proceeds of said tax are to be used for the operation, <br /> 28 maintenance or capital needs of the Everett Transit System. <br /> 29 Section 3. The levy and collection of said tax shall be conducted by <br /> 30 the State of Washington Department of Revenue, on behalf of the City of <br /> 31 Everett, in accord with the provisions of R.C.W. 82.08, R.C.W. 82.12, <br /> 32 R.C.W. 82. 14 and any other applicable State or local law not in conflict with <br />
