AN ORDINANCE establishing street improvement requirements <br /> for developments in the vicinity of Casino Road between <br /> Airport Road and Evergreen Way. <br /> -,,- <br /> WHEREAS, the City Council has adopted Ordinance No. 5f -7 amending <br /> Title 13 of the Everett City Code to include construction of City Streets <br /> to minimum standards for development/improvement of private property; and <br /> WHEREAS, the accelerated growth rate currently being experienced along <br /> and near Casino Road from Airport Road to Evergreen Way has prompted concern <br /> for efficiency and safety of traffic on Casino Road; and <br /> WHEREAS, the Casino Road facility is typically a 20-foot asphalt road, <br /> with 4-foot gravel shoulders and deep open-ditch drainage and does not <br /> include facilities for pedestrians; and <br /> WHEREAS, the additional development will increase traffic volumes on <br /> Casino Road, ultimately requiring a 5-lane facility including a continuous <br /> two-way left turn lane, sidewalks, drainage, and other appurtenances; and <br /> WHEREAS, a three-lane facility including a continuous two-way left <br /> turn, pedestrian facility, and enclosed drainage will be required to <br /> maintain safe and efficient traffic flow during an interim before the <br /> ultimate improvement is needed; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Definitions <br /> A. Benefit Area shall be shown in Exhibit 1, incorporated by reference <br /> herein as if fully set forth, and defined as that area in the City <br /> limits of Everett between Evergreen Way and Airport Road which <br /> contribute significant traffic to Casino Road. Said benefit area <br /> is for the purpose of this Ordinance and shall not limit, exclude <br /> or expand projections or calculations of benefit area for other <br /> purposes including but not limited to a local improvement district. <br /> B. Payment Guarantee shall be defined as a security, bond or other <br /> dodument: guaranteeing payment to the City upon 30-days notice to <br /> do so, in an amount equal to the applicable amount described in <br /> Section 2.B of this Ordinance with an adjustment for interest; said <br /> payment guarantee on a form which shall be approved by the City Attorney. <br /> C. Performance Bond shall be defined as a bond, cash deposit or <br /> equivalent security posted by the property owner or developer <br /> guaranteeing full performance of construction requirements in <br /> accordance with plans approved by the City Engineer. <br /> D. Significant traffic shall mean one or more vehicle trips per day <br /> to be generated by a development or improvement, if that development <br /> or improvement abuts upon or has cul-de-sac or primary access to <br /> any portion of Casino Road lying between Airport Road and Evergreen <br /> Way; provided, however, "significant traffic" shall mean 50 or more <br /> Casino Road vehicle trips per day to be generated by any plat, <br /> commercial or multiple family development for developments and <br /> improvements not abutting upon and not a cul-de-sac or primary <br /> access to Casino Road, but located within boundaries of the Casino <br /> Road benefit area (Exhibit 1) . <br /> -1- <br />
