r i M ORDINANCE NO. 538-78 AN ORDINANCE providing for the vacation of ALL THAT PORTION OF HIGHWAY PLACE LYING SOUTH AND EAST OF EVERGREEN WAY. WHEREAS, the City Council of the City of Everett did by Resolution No. 1468 duly adopted, fix the 12th day of July, 1978 at 7: 00 p.m. of said day for the day of public hearing; and WHEREAS, due and legal notice of the time and place of said hearing and determination of said resolution has been given by the City Clerk in the manner prescribed by law; and WHEREAS, at the time and place fixed for hearing, favorable statements and objections to the vacating of the herein described street were heard and discussed; and WHEREAS, it now appears to the City Council of the City of Everett that the portion of said street resolved to be vacated should be vacated; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That portion of Highway Place lying between Blocks 1 and 2, Beverly Hills Division No.4, according to plat thereof recorded in Volume 10 of Plats, page 97 , records of Snoho- mish County, Washington described as follows : Beginning at the southwest corner of Lot 11 of said Block 1; thence north along the west line of said Lot 11 to a point on the west line of Lot 5 of said Block 1 that is 10 feet north of the Wuthwest corner thereof; thence west parallel to the south line and 10 feet distant of said Lot 5, to the easterly right-of-way line of Evergreen Way; thence southwesterly along the easterly right-of-way line of Evergreen Way to the northwest corner of Lot 1 of said Block 2; thence east along the curve along the north line of said Lot 1 to the northwest corner thereof; thence south along the east line of said Lot 1 to a point on the east line of Lot 5 of said Block 1, that is 10 feet south of the northeast corner thereof; thence N 45°00 ' 00" E to a point
