r <br /> of intersection with the existing centerline <br /> of said Highway Place; thence north along the <br /> centerline of said Highway Place to a point of <br /> intersection with the westerly projected south <br /> line of Lot 11 of said Block 1; thence east <br /> along the westerly projected south line of said <br /> Lot 11 to the point of beginning <br /> be and the same is hereby vacated. <br /> Section 2: <br /> The City of Everett, its successors or assigns shall not <br /> be responsible or liable for storm drainage runoff result- <br /> ing from existing drainage patterns as established on <br /> City rights-of-way that may now or in the future go over, <br /> under, or across the above described street vacation. <br /> Section 3: <br /> That this ordinance shall not become effective until the <br /> owners of the property abutting upon that portion of High- <br /> way Place herein described shall convey to the City of <br /> Everett a new right-of-way across the south 60 feet of <br /> Lot 5, Block 2, Beverly Hills Division No. 4, and shall <br /> construct thereon a new 32 foot curb-to-curb asphalt <br /> roadway with concrete sidewalk on one side and concrete <br /> curbs and gutters as directed by the City Engineer. <br /> Section 4 : <br /> That the City of Everett retain an easement to construct, <br /> operate, maintain, repair and replace all public utilities <br /> under, over and across all of said vacated property. The <br /> City of Everett further retains the right to grant to <br /> public and private utilities the right to construct, <br /> operate, maintain, repair and replace utility lines, <br /> including but not limited to telephone, gas and electrical, <br /> under, over and across all of said vacated property. <br /> CITY OF EVERETT <br /> Mayor <br /> Attest: <br /> pe ?
