• <br /> H. NON-CONFORMING USE <br /> 1. A structure or the use of a structure or premises which <br /> was lawful before the passage of this Chapter but which is <br /> not in conformity with the provisions of this Chapter may <br /> be continued subject to the following conditions: <br /> a. No such use shall be substantially improved except <br /> in conformance with this chapter. <br /> b. No structural alteration, addition or repair to any <br /> non-conforming structure shall exceed 50% of its <br /> value at the time of its becoming a non-conforming <br /> use, unless the structure is permanently changed <br /> to a conforming use. <br /> c. If a non-conforming use or structure is destroyed by <br /> any means, including floods, to an extent of 50% or <br /> more of its value, it shall not be reconstructed except <br /> in conformity with the provisions of this Chapter. The <br /> Building Official may permit reconstruction if the use <br /> or structure is located outside the floodway and upon <br /> reconstruction is adequately and safely flood proofed, <br /> elevated, or otherwise protected in conformance with <br /> Section G. <br /> e. Uses which are or become nuisances shall not be entitled <br /> to continue as non-conforming uses. A nuisance is a <br /> flood use which obstructs flow, causing substantial <br /> injury to other lands or the public. <br /> f. The Building Official shall prepare a list of those non- <br /> conforming uses which have been flood proofed or otherwise <br /> -12- <br />
