A,L-7� AN ORDINANCE relating to noise control; providing for administration and enforcement, defining offenses, and prescribing penalties. 1 2 3 4 BE IT ORDAINED BY THE CITY OF EVERETT AS FOLLOWS: 5 Section 1: Declaration of Policy and Finding of Special Conditions. 6 a. DECLARATION OF POLICY. It is hereby declared to be the policy of 7 the City of Everett to minimize the exposure of citizens to the harmful physiological 8 and phychological effects of excessive noise. It is the express intent of the City 9 Council to control the level of noise in a manner which promotes commerce; the use, 10 value, and enjoyment of property; sleep and repose; and the quality of the environment. 11 b. FINDINGS OF SPECIAL CONDITIONS. The problem of noise in the City 12 has been studied since 1972 by the Safety Director of Everett. On the basis of these 13 studies the City Council hereby finds that special conditions exist within the City of 14 Everett which make necessary any and all differences between this ordinance and the 15 regulations adopted by the Department of Ecology. 16 Section 2: Definitions. 17 All technical terminology used in this ordinance, not defined, shall be interpreted 18 in conformance with American National Standards Institute Specifications, Section 1.1- 19 1960 and Section 1.4-1971. For purposes of this ordinance the words and phrases used 20 herein shall have the meaning indicated below: 21 a. ADMINISTRATOR means Noise Control Administrator as established in 22 Section 7. 23 b. dB (A) means a sound level, measured in decibels, using the "A" frequency 24 weighting network of a sound level meter. 25 c. DISTRICT means the land use zones to which the provisions of this 26 ordinance are applied. For the purposes of this ordinance the following noise control 27 districts shall be established which include land use zones designated in the Everett 28 Comprehensive Zoning Ordinance as follows: 29 30 31 32
