• <br /> • <br /> • <br /> • <br /> • <br /> 1 b. ADMINISTRATIVE PROCEEDING. Whenever the Administrator has <br /> 2 received a valid complaint from an identifiable person who owns, rents or leases <br /> 3 property that is affected by a noise source, and as a result has reason to believe that an <br /> 4 unlawful act under this ordinance has been committed, he may serve a written notice <br /> 5 and order directed to the owner or operator of the source, the person in possession of <br /> 6 the property where the sound originates, or the holder of a variance. One copy shall <br /> 7 also be posted on the property or source if reasonably possible, and another copy shall <br /> 8 be mailed to each complaintant about the noise, and additional copies may be mailed to <br /> 9 other interested or affected persons as the Administrator deems appropriate. <br /> 10 1. The notice shall contain a brief and concise description of <br /> 11 the conditions alleged to be in violation or to be a public nuisance noise, <br /> 12 the provisions of this ordinance alleged to have been violated, and sound <br /> 13 level readings, if taken, including the time and place of their recording. <br /> 14 2. The order shall contain a statement of the corrective action <br /> 15 required and shall specify a reasonable time within which the action must <br /> 16 be accomplished. <br /> 17 b. FINAL ORDERS. Any order issued by the Administrator pursuant to <br /> 18 this ordinance shall become final unless, no later than ten days after the order is served, <br /> 19 a person named in the notice and order files an appeal with the Board of Adjustment (or <br /> 20 Hearing Examiner if applicable) in accordance with Section 10 of this ordinance. <br /> 21 c. SEPARATE OFFENSES. For enforcement purposes, each day, defined <br /> 22 as the 24-hour period beginning at 12:01 a.m., in which violation of this ordinance <br /> 23 occurs, shall constitute a separate violation. <br /> 24 Section 12: Penalties. <br /> 25 a. PUNISHMENT FOR VIOLATIONS AND CRIMES. Every offense defined <br /> 26 by this ordinance or conduct made unlawful thereby shall constitute a violation of the <br /> 27 Everett Criminal Code and any person convicted of a violation shall be punished by a <br /> 28 civil fine or forfeiture not to exceed Five Hundred Dollars ($500). <br /> 29 <br /> 30 <br /> 31 <br /> 32 Page -16- <br />
