•- • <br /> • <br /> r <br /> • <br /> • <br /> 1 b. PENALTY FOR FAILURE TO COMPLY WITH FINAL ORDERS. In <br /> 2 addition to any other sanction or remedial injunctive procedure which may be available <br /> 3 at law or equity, any person failing to comply with a final order issued by the <br /> 4 Administrator or Board of Adjustment (Hearing Officer if appropriate), shall be subject <br /> 5 to a cumulative civil penalty in an amount not to exceed One Hundred Dollars ($100) per <br /> 6 day from the date set for compliance until such order is complied with. The civil <br /> 7 penalty shall be collected by such action brought in the name of the City. <br /> 8 Section 13: Miscellaneous. <br /> 9 a. ORDINANCE ADDITIONAL TO OTHER LAW. The provisions of this <br /> 10 ordinance shall be cumulative and nonexclusive and shall not affect any other claim, <br /> 11 cause of action or remedy; nor, unless specifically provided, shall it be deemed to <br /> 12 repeal, amend or modify any law, ordinance or regulation relating to noise, but shall be <br /> 13 deemed additional to existing legislation and common law on noise. <br /> 14 b. SEVERABILITY. Should any section, subsection, paragraph, sentence, <br /> 15 clause or phrase of this ordinance or its application to any person or situation be <br /> 16 declared unconstitutional or invalid for any reason, such decision shall not affect the <br /> 17 , validity of the remaining portions of this ordinance or its application to any other <br /> 18 person or situation. <br /> 19 c. REPEALER.
