• <br /> • <br /> 1 c. SPECIFIC PROHIBITIONS. <br /> 2 1. MUFFLERS. Every motor vehicle operated upon the <br /> 3 public highways shall at all times be equipped with a muffler in good <br /> 4 working order and constant operation. <br /> 5 2. TIRE NOISE. It is unlawful for any person to operate a <br /> 6 motor vehicle in such a manner as to cause or allow to be emitted <br /> 7 squealing, screeching, or other such sound from the tires in contact with <br /> 8 the ground because of rapid acceleration or excessive speed around <br /> 9 corners or other such reason, provided that noise resulting from <br /> 10 emergency braking to avoid imminent danger shall be exempt from this <br /> 11 section. <br /> 12 3. ALTERATION OF MOTOR VEHICLES. It is unlawful for <br /> 13 any person to change or modify any part of a motor vehicle or install any <br /> 14 device thereon in any manner that permits sound to be emitted by the <br /> 15 motor vehicle in excess of the limits prescribed in Section 4, (a) and (b) of <br /> 16 this chapter. <br /> 17 Section 5: Public Nuisance and Disturbance Noises. <br /> 18 a. PUBLIC NUISANCE NOISES. Pursuant to Section 11 of this ordinance <br /> 19 the Administrator may determine that a sound constitutes a public nuisance noise as <br /> 20 defined herein. It is unlawful for any person to cause or allow to be emitted a noise <br /> 21 which has been determined a public nuisance noise. <br /> 22 b. PUBLIC DISTURBANCE NOISES. It is unlawful for any person to cause, <br /> 23 or for any person in possession of property to allow to originate from the property, <br /> 24 sound that is a public disturbance. No sound source specifically exempted from a <br /> 25 maximum permissible sound level by this ordinance shall be a public nuisance noise or <br /> 26 public disturbance noise insofar as the particular source is exempted. The following <br /> 27 sources of sound shall be public disturbance noises and are subject to regulation under <br /> 28 the provisions of Section 3 of this ordinance: <br /> 29 1. Frequent, repetitive, or continuous noise made by any <br /> 30 animal which unreasonably disturbs or interferes with the peace, comfort <br /> 31 <br /> 32 Page -6- <br />
