• <br /> , ORDINANCE NO. GZ <br /> AN ORDINANCE submitting for approval to the voters of Everett, <br /> Washington, on September 19, 1978, a proposition which if approved by <br /> a majority of the voters would fix and impose a Sales and Use Tax <br /> 1 within the City limits of Everett in accord with the terms of R.C.W. <br /> 82.14 but not to exceed three-tenths of one percent of the selling price <br /> 2 or value of the article used, the proceeds which are to be used for the <br /> operation, maintenance or capital needs of Everett Transit; and, <br /> 3 conditioned upon said approval, repealing the Household and Employee <br /> Excise Tax levied pursuant to R.C.W. 35.95.040 for transit purposes. <br /> 4 <br /> 5 WHEREAS, R.C.W. 35.92.060 authorizes cities to operate and maintain a public <br /> 6 transportation system within its limits; and <br /> 7 WHEREAS, Everett Transit was established to operate a public transportation <br /> 8 system within the City of Everett; and <br /> 9 WHEREAS, funding for said Everett Transit System is derived in part by the <br /> 10 imposition of a one dollar ($1) per Household Excise Tax and a $.25 Employee Tax, <br /> 11 pursuant to R.C.W. 35.95.040; and <br /> WHEREAS, the City Council of the City of Everett finds that the Household and <br /> 12 <br /> Employee Tax, as used for this purpose, is no longer adequate in that it is tied to a tax <br /> 13 <br /> base which does not grow concomitant with the growth rate in transportation costs; and <br /> 14 <br /> WHEREAS, a need exists to establish an alternative tax source for the Everett <br /> 15 <br /> Transit System which would maintain revenues adequate to keep abreast of increased <br /> 16 <br /> operation and maintenance and capital costs; and <br /> 17 <br /> WHEREAS, R.C.W. 82.14.045 authorizes cities of Washington to establish, in lieu <br /> 18 <br /> of the Excise Tax authorized to be levied against households pursuant to R.C.W. <br /> 19 <br /> 35.95.040, a Sales and Use Tax within the limits of the City to provide funds for <br /> 20 <br /> operation, maintenance or capital needs of a public transportation system, provided that <br /> 21 <br /> the City submit an authorizing proposition to the voters of the City and provided that <br /> 22 <br /> such tax not be imposed without the approval of a majority of persons voting thereon; <br /> 23 <br /> and <br /> 24 <br /> WHEREAS, the City Council of Everett finds that it would be in the interest of <br /> 25 <br /> the citizens of the City of Everett for such a proposition to be submitted to them for <br /> 26 <br /> vote in the September 19, 1978, Primary Election. <br /> 27 <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br /> 28 <br /> OF EVERETT AS FOLLOWS: <br /> 29 <br /> 30 <br /> 31 <br /> 32 <br />
