• <br /> (1) There are exceptional or extraordinary circumstances or <br /> conditions applying to the subject property which do not - <br /> apply generally to other properties in the same vicinity <br /> or zone. <br /> (2) The authorization of the variance will not be detrimental <br /> to the public welfare or injurious to property in the vicinity <br /> or zone in which the property is located. <br /> (3) There is no reasonable alternative which would allow for <br /> an acceptable design of the short subdivision in accordance <br /> with existing standards and procedures. <br /> (4) The application for short subdivision has been processed <br /> by the City Engineer who confirms that the final approval <br /> of the short subdivision cannot be granted without an <br /> authorized variation from the Board. <br /> Furthermore, when granting a variation to allow easement <br /> access to any lot, the Board shall determine that: <br /> (a) Easements serving not more than one lot or parcel shall <br /> have an effective width of not less than twenty (20) feet. <br /> (b) A common easement serving two lots or parcels shall have <br /> an effective width of not less than thirty (30) feet. <br /> (c) The method and responsibility for maintenance of access <br /> along the easement shall be specified in the easement <br /> document and shall be stated on the face of the final <br /> short subdivision plan. <br /> (d) No more than one lot may be served by easement for each <br /> lot fronting on an improved public street in any one <br /> short subdivision. <br /> (e) The computation of minimum lot size and set-back require- <br /> ments for rear lots served by the easement shall not <br /> include the easement itself. <br /> Sect. 210 Resubdivision Restricted <br /> Land within an approved short subdivision shall not be <br /> resubdivided for a period of five years from the date of <br /> approval of the short subdivision without the submission and <br /> approval of a final subdivision pursuant to all provisions of <br /> Chapters 18.04 through 18.40 concerning the subdivision of <br /> land into five or more lots, tracts or parcels. <br /> When the original short subdivision contains less than <br /> four lots, the above stipulation shall not apply to the <br /> creation of additional lots , not exceeding a total of four. <br /> In that case a new application consistent with the then current <br /> short subdivision regulations is required. After five years, <br /> further division may be permitted when otherwise consistent <br /> with the then current regulations of the City. <br /> Where there have been no dedications to the public and <br /> no sales of any lots in a short subdivision, nothing contained <br /> in this section shall prohibit a subdivider from completely <br /> withdrawing his entire short subdivision and thereafter pre- <br /> senting a new application. <br /> Sect. 220 Final Approval <br /> A. Every short plat or short subdivision filed for record <br /> must contain a certificate giving a full and correct des- <br /> cription of the lands divided as they appear on the short plat, <br /> including a statement that the short subdivision has been made <br /> with the free consent and in accordance with the desires of the <br /> -7- <br />
