r •ice • ,,'',_ <br /> owner or owners.- If the short plat includes a dedication, the <br /> certificate shall also contain the dedication of all streets <br /> and other areas to the public, and individual or individuals, <br /> religious society or societies or to any corporation, public or <br /> private as shown on the short plat and a waiver of all claims <br /> for damages against any governmental authority which may be <br /> occasioned to the adjacent land by the established construction, <br /> drainage and maintenance of said road. Said certificate shall <br /> be signed and acknowledged before a notary public by all parties <br /> having any interest in the lands subdivided. <br /> Every short plat filed for record must be accompanied by a <br /> current short plat certificate confirming that the title of the <br /> lands as described and shown on said short plat is in the name <br /> of the owners signing the certificate. <br /> B. Final approval of a short subdivision shall be given by <br /> the City Engineer subject to the satisfactory completion of <br /> all improvements which may have been specified as part of the <br /> tentative approval. <br /> Alternatively, final approval of a short subdivision may <br /> be given subject to the prepayment by the subdivider to the <br /> City of a bond equal in amount to 120 percent of the estimated <br /> cost of the improvements as determined by the City Engineer. The <br /> specified improvements must be completed within one year from <br /> date of approval. <br /> In the event that the specified improvements have not been <br /> carried out to the satisfaction of the City Engineer within one <br /> year from the date of approval, the City may, after giving ten (10) <br /> days written notice to the subdivider, complete all or any <br /> part of the specified improvements either by contract or by force <br /> account or by both contract and force account. <br /> The cost of such works shall be deducted from the bond monies <br /> held by the City, and any residual monies shall then be refunded <br /> to the subdivider. <br /> If the cost of the improvements exceeds the amount of bond <br /> monies held by the City, the subdivider shall be liable therefor <br /> and shall pay to the City the difference between the bond amount <br /> and the actual cost of the improvements. <br /> C. The City Engineer shall evidence that every requirement as <br /> set forth in this Chapter has been satisfactorily met and shall <br /> evidence final approval of the short subdivision by placing his <br /> signature on the face of the short plat. <br /> D. The applicant(s) shall record the short plat and all other <br /> documents, as determined to be necessary by the City Engineer, <br /> which as a minimum shall include the short subdivision certifi- <br /> cate, legal description and declaration of short subdivision. <br /> The applicant shall furnish a certified mylar copy of the recorded <br /> short plat to the City Engineer. <br /> Sect. 230 Appeal Procedure <br /> Any applicant, aggrieved by the decision of the City <br /> Engineer relating to a short subdivision, may request review <br /> by the City Council. Such request must be made in writing to <br /> the City Clerk within twenty working days from the date on which <br /> the City Engineer presents the applicant with the final decision <br /> in writing. <br /> -8- <br />
