1 and/or approved and demonstrated to the City Engineer's satisfaction, ac- 2 ceptable compliance with its requirements, the City may, after inspection, 3 acceptance, and acknowledgment of the proper posting of the required bonds 4 as specified in Section 10 of this ordinance, assume operation and main- 5 tenance of the facilities. 6 In cases in which all or part of the drainage facilities are not accessible 7 for maintenance purposes due to overlying structures or other causes, the City 8 shall be held harmless for damages which might occur due to failure of design 9 or workmanship of those segments, and further will not be responsible for 10 11 their maintenance, replacement, or rehabilitation. In such cases, responsi- 11 bility shall revert to the existing owner of such facilities. 12 Section 12: Applicability to Governmental Entities 13 All municipal corporations and governmental entities shall be required 14 to submit a drainage plan and comply with the terms of this ordinance when 15 developing and/or improving land including, but not limited to, road 16 I building, and widening, buildings, facilities and parking lots within the 17 areas of the City. 18 ' It is recognized that many other city, county, state, and federal 19 permit conditions may apply to the proposed action and that compliance with 20 the provisions of this chapter does not constitute compliance with such 21 other requirements. 22 Section 13: Enforcement 23 1. Any person or persons violating this chapter or rule or 24 regulation adopted hereunder, or by any act of commission or omission, 25 procures, aids, or abets such violation, shall be guilty of a misdemeanor 26 and upon conviction, shall be punished by a fine not to exceed Five 27 Hundred Dollars ($500) and/or imprisonment for a term not to exceed ninety 28 (90) days. Each day such violation continues shall be considered an ad- 29 ditional misdemeanor offense. 30 31 32 ' 12
