1 and/or approved and demonstrated to the City Engineer's satisfaction, ac- <br /> 2 ceptable compliance with its requirements, the City may, after inspection, <br /> 3 acceptance, and acknowledgment of the proper posting of the required bonds <br /> 4 as specified in Section 10 of this ordinance, assume operation and main- <br /> 5 tenance of the facilities. <br /> 6 In cases in which all or part of the drainage facilities are not accessible <br /> 7 for maintenance purposes due to overlying structures or other causes, the City <br /> 8 shall be held harmless for damages which might occur due to failure of design <br /> 9 or workmanship of those segments, and further will not be responsible for <br /> 10 11 their maintenance, replacement, or rehabilitation. In such cases, responsi- <br /> 11 bility shall revert to the existing owner of such facilities. <br /> 12 Section 12: Applicability to Governmental Entities <br /> 13 All municipal corporations and governmental entities shall be required <br /> 14 to submit a drainage plan and comply with the terms of this ordinance when <br /> 15 developing and/or improving land including, but not limited to, road <br /> 16 I building, and widening, buildings, facilities and parking lots within the <br /> 17 areas of the City. <br /> 18 ' It is recognized that many other city, county, state, and federal <br /> 19 permit conditions may apply to the proposed action and that compliance with <br /> 20 the provisions of this chapter does not constitute compliance with such <br /> 21 other requirements. <br /> 22 Section 13: Enforcement <br /> 23 1. Any person or persons violating this chapter or rule or <br /> 24 regulation adopted hereunder, or by any act of commission or omission, <br /> 25 procures, aids, or abets such violation, shall be guilty of a misdemeanor <br /> 26 and upon conviction, shall be punished by a fine not to exceed Five <br /> 27 Hundred Dollars ($500) and/or imprisonment for a term not to exceed ninety <br /> 28 (90) days. Each day such violation continues shall be considered an ad- <br /> 29 ditional misdemeanor offense. <br /> 30 <br /> 31 <br /> 32 ' <br /> 12 <br />
