Any conditions which constitute or will constitute a violation <br /> 2 of any of the provisions of this chapter or rules or regulations adopted <br /> 3 hereunder shall constitute a nuisance for which the City may seek legal <br /> 4 or equitable relief to enjoin any acts or practices or abate any said <br /> 5 conditions. <br /> 6 3. Notwithstanding, any other provision of this ordinance, when- <br /> 7 ever the City Engineer finds that a violation of this chapter or rules or <br /> 8 regulations adopted hereunder has created or is creating an unsanitary, <br /> 9 dangerous, or other condition which, in his judgment, constitutes an <br /> 10 immediate hazard, he may suspend or revoke any permit for which the <br /> 11 approval of a drainage plan is required on the project or development <br /> 12 1 where the violation exists and suspend or terminate operations under <br /> 13 the permit immediately. <br /> 14 4. Penalty or enforcement provisions provided herein shall not <br /> 15 be exclusive, and the City may pursue any remedy or relief deemed ap- <br /> 16 propriate in a response to a violation of this new chapter to the Everett <br /> 17 Municipal Code or the rules and regulations adopted hereunder. <br /> 18 Section 14: Protection of Public/Private Rights <br /> 19 Implementation of any provision of this new Chapter to the Everett <br /> 20 Municipal Code shall not cause nor be construed as an infringement of the <br /> 21 rights of individuals, municipalities, or corporations other than the <br /> 22 developer seeking a permit or approval as described in Section 3. <br /> 23 Section 15: Effective Date <br /> 24 The requirements of this chapter shall apply to all plats receiving <br /> 25 preliminary approval subsequent to y / 7, f ?J 71,' . In the case <br /> / <br /> 26 of all additional actions enumerated in Section 3 of this ordinance, the <br /> 27 terms of this chapter shall apply where final action by the City has not <br /> 28 been taken prior to the effective date of this ordinance. <br /> 29 Section 16: Severability <br /> 30 If any provision of this chapter or its application to any person or <br /> 31 property is held invalid, the remainder of the chapter or the application <br /> 32 of the provision to other persons or circumstances shall not be affected. <br /> 13 <br />
