1 Section 6: Development in Critical Areas <br /> 2 Development which would increase the volume or rate of discharge due to <br /> 3 any storm from the subject property shall not be permitted in areas designated <br /> 4 as critical areas in the Comprehensive Drainage Plan. Critical areas are <br /> 5 those in which existing flooding, drainage, erosion, and/or instability <br /> 6 conditions present an imminent likelihood of harm to the welfare and safety <br /> 7 of the surrounding community, or to the integrity of the surface or ground- <br /> 8 water system. Development shall not be permitted in these critical areas <br /> 9 until such time as the existing community hazard is alleviated and it is <br /> 10 adequately demonstrated that the proposed development will not cause a <br /> 11 recurrence of the problem nor the occurrence of any new drainage-related <br /> 12 problem. The City Engineer may also designate as critical any area in <br /> 13 which comparable problems would occur in the future due to any increase <br /> 14 in volume or peak discharge. The requirements of this section shall <br /> 15 apply regardless of any variance under Section 3, item (4) . Where ap- <br /> 16 plications of the provisions of this section will deny all reasonable uses <br /> 17 of the property, the restrictions on development contained in this section <br /> 18 may be waived for the subject property, provided that the resulting <br /> 19 development shall be subject to all the remaining terms and condition of <br /> 20 this new Chapter of the (EMC) . All decisions based on the provision of <br /> 21 this section shall be compatible with the Comprehensive Drainage Plan for <br /> 22 the basin in which the subject property is located. For development in <br /> 23 areas designated as critical, the developer shall provide information <br /> 24 regarding volume and rate of discharge for a range of storms as specified <br /> 25 in the Procedures Manual. <br /> 26 Section 7: Review and Approval of the Plan <br /> 27 All surface and storm drainage plans prepared in connection with any <br /> 28 of the permits and/or approvals listed in Section 3 of this Chapter shall <br /> 29 be submitted for review and approval by the City Engineer. <br /> 30 <br /> 31 <br /> 32 <br /> 8 <br />
