ORDINANCE NO. _y—Cer — 7f <br /> AN ORDINANCE amending the City Criminal Code <br /> Ordinance, No. 466A-77, to include carrying and <br /> discharge of firearms, disorderly house, and a penalty <br /> provision for Section 109 - Displaying Erotic <br /> 1 Material. <br /> 2 <br /> 3 WHEREAS, the City Criminal Code Ordinance, No. 466A-77, was adopted by the <br /> 4 City of Everett; and <br /> 5 WHEREAS, the City Council finds it unlawful for any person to carry on his <br /> 6 person any instrument to be used as a weapon unless properly licensed to do so; and <br /> 7 WHEREAS, the City Council finds it unlawful to discharge anything containing <br /> 8 powder or explosive; and <br /> 9 WHEREAS, the City Council finds it unlawful for anyone to maintain any place <br /> 10 for the purpose of prostitution or lewdness; and <br /> 11 WHEREAS, the City Council finds it unlawful for anyone to permit any type of <br /> 12 disorderly conduct on his premises; and <br /> 13 WHEREAS, the City Council finds it necessary to designate a penalty for the <br /> 14 crime of Displaying Erotic Material; <br /> 15 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 16 Section 1: That the City Criminal Code Ordinance, No. 466A-77, is hereby <br /> 17 amended by the addition of the following sections: <br /> 18 Section 119 Firearms - Carry and Discharge <br /> 19 1. It is unlawful for any person to carry upon his person any concealed <br /> weapon or any instrument to be used as a weapon including, but not <br /> 20 limited to, revolver, pistol, rifle, shotgun, or other firearm, or any knife <br /> other than an ordinary pocket knife, or any dirk or dagger. <br /> 21 a. Subsection 1 shall not apply to any person who has obtained a valid <br /> 22 license for carrying a pistol concealed on his person pursuant to <br /> RCW 9.41.070. <br /> 23. 2. It is unlawful for any person to fire off or discharge any bomb, gun, pistol <br /> 24 or firearm of any kind. <br /> 25 a. In any prosecution under subsection 2, it is an affirmative defense <br /> if it was done so in the lawful defense of one's person or property. <br /> 26 3. The above subsections - 1, 2 - shall not apply to any law enforcement <br /> 27 officer, or to any member of the army, navy, or marine corp of the United <br /> States, or to any other person as set forth in RCW 9.41.060. <br /> 28 4. Penalty. Class A Offense. <br /> 29 <br /> Section 120 Disorderly House <br /> 30 <br /> 1. It is unlawful for any person to open, conduct, keep, or maintain any place <br /> 31 resorted to for the purpose of prostitution or lewdness. <br /> 32 <br />
