It is unlawful for any person to allow, permit, or authorize in any building <br /> or place owned by him, or under his control, any riotous or disorderly <br /> 2 conduct, or drunkenness, or fighting, to the annoyance of the public. <br /> 3 3. Penalty. Class B Offense. <br /> 4 Section 2: That section 109 - Displaying Erotic Material - of Ordinance No. <br /> 5 466A-77 is hereby amended to read as follows: <br /> 6 <br /> Section 109 Displaying Erotic Material <br /> 7 <br /> 1. As used in this section 109 <br /> 8 <br /> a. "Erotic material" shall mean stage performances, motion pictures, <br /> 9 photographs, pictures, printed material and other objects or <br /> matter, the dominant theme or effect of which is sexual arrousal or <br /> 10 sexual excitement. <br /> 11 2. It is unlawful for any person, firm, corporation or association to operate <br /> premises wherein erotic material is sold, dispensed, shown, demonstrated, <br /> 12 distributed, communicated or given away unless: <br /> 13 a. All doors to areas of the premises into which patron, guests or <br /> visitors might gain access are unlocked and readily accessible at all <br /> 14 times during business hours to law enforcement personnel in the <br /> performance of their duties; and <br /> 15 <br /> b. The entire premises shall have, at least, minimum illumination <br /> 16 generally distributed in all parts of the premises at all times when <br /> patrons, guests or visitors are allowed to enter or remain therein; <br /> 17 and <br /> 18 c. Any enclosure, cubicle or other area within the premises which is <br /> used for viewing, selling, dispensing, showing, demonstrating, <br /> 19 distributing or giving away erotic material shall be of such <br /> construction or arrangement that it allows a person using it to be <br /> 20 visible downward from the waist from the entrance to the <br /> premises; and <br /> 21 <br /> d. No persons under the age of twenty-one (21) shall be allowed to <br /> 22 enter or remain in or upon such premises or areas of premises. <br /> 23 3. Provided, however, nothing in this section shall apply to a <br /> public museum or library. <br /> 24 4. Penalty.
