• <br /> b. Conditional Use upon compliance with this Chapter <br /> (Section G) shall be issued a Flood Zone Permit. <br /> G. CONDITIONAL USES <br /> 1. Applications for a Conditional Use shall be made on forms <br /> provided by the Planning Department . <br /> 2. The decision to issue a Conditional Use Permit shall <br /> he based on the proposed project' s effect on life and <br /> property due to increased flood heights or velocities <br /> caused by encroachments and Section 1910 . 6 of the Federal <br /> Regulation (Title 24 CFR) . <br /> 3 . Upon consideration of Section G. 2 . and the purposes of <br /> this Chapter, conditions may be attached to conditional <br /> uses which shall relate to the flood hazard existing <br /> at a specific site. Any measures utilized to flood proof <br /> a project shall be certified by a registered engineer <br /> to be consistent with the flood factors for that project <br /> area. <br /> H. NON-CONFORMING USE <br /> 1. A structure or the use of a structure or premises which <br /> was lawful before the passage of this Chapter but which <br /> is not in conformity with the provisions of this Chapter <br /> may be continued subject to the following conditions : <br /> a. No such use shall be substantially improved except in <br /> conformance with this chapter. <br /> b. No structural alteration, addition or repair to any <br /> non-conforming structure shall exceed 50% of its <br /> value at the time of its becoming a non-conforming <br /> -10- <br />
