Not more than one such <br /> license shall be issued for each fifth thousand of total population of the <br /> 2 city, as shown by the last preceding state or federal census; provided, that <br /> nothing contained in this section relating to residence, citizenship or per <br /> 3 capita limitation of licenses shall apply to any person now holding a valid <br /> amusement arcade license. <br /> 4 <br /> 5 is hereby amended to read as follows: <br /> 6 <br /> 5.12.020 Amusement arcade license. <br /> 7 <br /> It is unlawful to operate or conduct, own, or be employed in, an <br /> 8 amusement arcade unless a valid "amusement arcade license" has been <br /> procured and is conspicuously displayed in each such amusement arcade. <br /> 9 No amusement arcade license shall be issued except to a citizen of the <br /> United States who has been a resident of the state for at least five years <br /> 10 prior to filing application therefor. No limit shall be set on the number of <br /> amusement arcade licenses issued, but if under the discretion of the City <br /> 11 Clerk and City Council, the number issued becomes unmanageable, <br /> unreasonable, or detrimental to public welfare, the City reserves the right <br /> 12 to place a limit on the number of said licenses issued. <br /> 13 <br /> Section 3: That EMC 5.12.030 which reads as follows: <br /> 14 <br /> 15 5.12.030 Location amusement device license. <br /> 16 It is unlawful for any person to display, exhibit or expose or permit <br /> to be displayed, exhibited or exposed for purpose of use, play or operation, <br /> 17 or permit to be used, played or operated, for profit, any amusement <br /> device without having a valid and subsisting license, to be designated as <br /> 18 "location amusement device license." A separate location license is <br /> required for each place of business and shall at all times be conspicuously <br /> 19 posted and maintained in each place of business. The city clerk shall <br /> prescribe the form of location license, shall designate a number therefor, <br /> 20 and shall indicate thereon the number of such devices which may be <br /> exhibited, exposed, used or played thereunder. <br /> 21 <br /> 22 is hereby amended to read as follows: <br /> 23 5.12.030 Business owner device license. <br /> 24 It is unlawful for any business owner to display, exhibit, or expose, <br /> 25 for purpose of use, play or operation any amusement device of which said <br /> business owner holds legal title without having a valid and subsisting <br /> 26 license to be designated as a "business owner device license." A separate <br /> device license is required for each amusement device of which business <br /> 27 owner holds legal title. Said license shall consist of a tab, sticker, or <br /> similar identification, numerically designated and dated by the City Clerk. <br /> 28 Said license shall be permanently affixed to the device for which it is <br /> issued, in a conspicuous place. <br /> 29 <br /> 30 Section 4: That EMC 5.12.040 which reads as follows: <br /> 31 <br /> 32 <br />
