(e) promises performance which the actor does not intend <br /> to perform or knows will not be performed; or <br /> (f) uses a credit card: <br /> (1) without authorization; or <br /> (2) which he knows to be stolen, forged , revoked <br /> or cancelled. <br /> The term "deception" does not include falsity as to matters <br /> having no pecuniary significance. <br /> (3) "Obtain" means: <br /> • <br /> (a) in relation to property, to bring about a transfer or <br /> purpox•tcd transfer to the obtainer or another of a <br /> legally recognized interest in the property; or <br /> (b) in relation to lalbor or service, to secure performance • <br /> thereof for the benefit of the obtainer or another. <br /> • (4) "Obtains or exerts unauthorized control" over property <br /> • includes but i.s not necessarily limited to conduct heretofore <br /> defined or known as common law larceny by trespassory <br /> taking, common law larceny by trick, larceny by conversion, <br /> embezzlement, extortion, or obtaining property by false <br /> pretenses. <br /> (5) "Owner" means a person, other than the actor, who has <br /> possession of or any other interest in the property involved, <br /> and without whose consent the actor has no authority to <br /> exert control over the property. <br />
