1 CHAPTER TWO <br /> 2 §201(c) - RIGHT OF ENTRY. Whenever necessary to make an inspection <br /> to enforce the City's codes regulating the construction, maintenance and re- <br /> t pair of buildings and their appurtenances such as the Building Code, Housing <br /> 4 Code, Dangerous Building Ordinance, Electrical Code and Fire Code, or <br /> whenever there is reasonable cause to believe there exists a violation of such <br /> 5 ordinance or codes, the Fire Chief, Building Official or their authorized re- <br /> presentatives may , upon presentation of their proper credentials , enter such <br /> 6 buildings or premises to inspect the same or to perform any duty imposed <br /> upon him by ordinance only after forty-eight hours of advance notice has been <br /> 7 given by certified mail and requested return receipt outlining reasons and the <br /> time for inspection and stating that the property owner has the right to refuse <br /> 8 entry subject to review by a court of competent jurisdiction, provided how- <br /> 9 ever, this section shall not be applicable to emergency situations endangering <br /> the persons or property , and provided further that the forty-eight hour ad- <br /> 10 vance notice may, in the discretion of the appropriate inspecting officer, be <br /> dispensed with in the inspection of buildings in which the general public is <br /> 11 invited , or in the inspection of buildings or structures under construction, <br /> repair, alteration or removal or in the inspection of any abandoned building. <br /> 12 <br /> 13 In the event the owner and/or occupant refuses entry after such request <br /> has been made, the official is empowered to seek the assistance from any <br /> 14 court of competent jurisdiction upon notice to said owner and occupant. <br /> (Ordinance No. 315-74 §2 , 1974.) <br /> 15 <br /> §205 - BOARD OF APPEALS . In order to determine the suitability of alter- <br /> 16 nate materials and methods of construction and to provide for a reasonable <br /> interpretation of the provisions of this Code, there shall be and is hereby <br /> 17 created a Board of Appeals , consisting of seven members who are qualified <br /> 18 by experience and training to pass upon matters pertaining to building con- <br /> struction. The Building Official shall be an ex officio member and shall act <br /> 19 as Secretary of the Board. The Board of Appeals shall be appointed by the <br /> Mayor and shall hold office at his pleasure. The Board shall adopt reasonable <br /> 20 rules and regulations for conducting its investigations and shall render all <br /> decisions and findings in writing to the Building Official with a duplicate copy <br /> 21 to the appellant and may recommend to the City Council such new legislation <br /> as is consistent therewith. <br /> 22 <br /> 23 CHAPTER THREE <br /> 24 <br /> §303. For the purposes of this Code, the power to order abatement by re- <br /> 25 pairing, rehabilitation, demolition or removal shall include the power to order <br /> a dangerous building which is vacant or for which an order of vacation is in <br /> 26 effect secured against unauthorized entry. <br /> 27 §304. For the purposes of this Code, the Director of Public Works shall be <br /> 28 the City Engineer. <br /> 29 <br /> CHAPTER FOUR <br /> 30 <br /> §401(b) (3) (iii) . If the Building Official has determined that the building <br /> 31 or structure must be demolished, the order shall require that the building be <br /> 32 <br /> -2- <br />
