19. All grants of rights-of-way by agencies to utilities for <br /> use for distribution (as opposed to transmission) purposes . • <br /> 20. Issuances of agricultural leases covering one hundred sixty <br /> contiguous acres or less. <br /> 21. Issuances of leases for school sites . <br /> 22. Development of recreational sites not specifically designed <br /> for all-terrain vehicles and not including more than twelve <br /> campsites . <br /> In the case of any such action proposed for an environmentally <br /> sensitive area, the categorical exemptions of this subsection <br /> shall not apply and the threshold determination process shall <br /> be complied with. <br /> C. Major actions which will be located wholly or partially within <br /> an environmentally sensitive area are to be treated no differently <br /> than other major actions under these guidelines. A threshold <br /> determination shall be made for all such actions, and an EIS shall <br /> not be automatically required for a proposal merely because it is <br /> proposed for location in an environmentally sensitive area. <br /> D. Certain exemptions do not apply on lands covered by water, and this <br /> remains true regardless of whether or not lands covered by water <br /> are mapped. <br /> is hereby repealed . <br /> Section 3: Section 11-C(1) which reads as follows : <br /> 1. The Responsible Official shall maintain a list of consultants <br /> qualified to prepare environmental impact statements and said <br /> list shall be certified by the Environmental Review Committee. <br /> is hereby amended to read as follows : <br /> 1. The Responsible Official shall maintain a list of consultants <br /> qualified to prepare environmental impact statements . <br /> Section 4: Section 11-C(2) of Ordinance No. 406-76 which reads as follows: <br /> 2. Any applicant required to submit data for the Draft EIS shall be <br /> deemed to have fulfilled the requirements of this Ordinance by <br /> utilizing the services of a consultant included upon the certified <br /> consultants' list, PROVIDED that the Responsible Official delay <br /> distribution of the Draft EIS, when necessary, to correct any <br /> deficiencies in the data submitted and that the consultant shall <br /> provide such information as is required under Section 11-A of this <br /> Ordinance. <br /> is hereby amended to read as follows : <br /> -4- <br />
